DATE: MARCH 11, 1997 (MEETING OF MARCH 19, 19'977 I ACTION: SUBJECT: CONSIDER EXPORT REQUEST (PAUL BURNS) RW BACKGROUND The applicant (Paul Burns) has requested the City to allow him to export approximately 50,000 cubic yards of earth to the proposed elementary school located at Casey Road. Staff was also notified by Moorpark Unified School District of its intentions to grade and import soil to the school site on Casey Road. The School District has submitted plans to the City for preliminary review. Staff informed the District that plans were incomplete on 1/31/97. No subsequent submittal has been received as of 3/11/97. Approximately two-thirds of the material proposed to be exported from the Burns site was received from a nearby Flood Control sediment/detention facility and stockpiled for agricultural grading. Because of this stockpiled soil's unsuitability for agricultural purposes and because of the School District's need for at least this amount of fill for grading at the school site, the applicant has opted to export this material to the school instead of using it for the grading on the agricultural land. In addition to the stockpiled soil, approximately one third of the requested export amount is native soil. Removal of the native soil will require a maximum cut of 3 feet over an area of roughly 450 feet by 300 feet. This native material is located underneath the existing stockpiles and will be removed in such a way as to blend with the existing contours at that location. A grading plan depicting this work has also been submitted to the Engineering department for its review. No export is proposed until the school grading plan has been reviewed and a grading permit is issued. Mr. Burns has submitted a proposed haul route for the City's approval. The route is shown on the attached Exhibit 1. Trucks will be loaded at his property then proceed across Gabbert Road, just north of the railroad track crossing. After crossing Gabbert Road the trucks will proceed along the north side of Ventura County Flood Control District's levee road, adjacent to the Hitch Ranch property, then enter the southwest corner of the School District property. Staff estimates that there will be about 4,200 truck trips associated with this haul operation. The applicant has indicated that minor brush removal will be done in two areas adjacent to the haul road to facilitate a two way passing area for the trucks along the haul route (See Exhibit 2). This brush removal activity will be limited to the areas shown and will require no grading within the Hitch Ranch property (Specific Plan Area W . ANALYSIS Staff has reviewed the applicant's site excavation plan and is prepared to issue an export grading permit for the source location. Use of the proposed haul route will eliminate truck traffic from the City streets and downtown area at High Street and Moorpark Avenue. Due to the large number of loaded trucks crossing Gabbert Road, it is anticipated that the crossing area may incur some damage. The area of potential damage is limited to the Gabbert Road and staff has estimated that a $5,000 cash security will be sufficient for any necessary repairs at this location. Staff has notified the applicant that this security will be a requirement of the encroachment permit. Mr. Burns has stated that he is willing to comply with the requirement. Mr. Burns has provided staff with information regarding approvals from the owners of the properties on the haul route. These documents indicate that the owners (Ventura County Flood Control and Hitch Ranch) would be willing to grant Mr. Burns permission to haul across their properties. These approvals are contingent upon certain of their conditions which Mr. Burns must still meet. It is Staff's opinion that the City also impose the following conditions: Grading Permit Conditions Prior to the issuance of a Grading Permit the applicant shall: Submit a $5000 cash deposit or other approved security for road repairs to Gabbert Road; verify that a grading permit has been given to the Moorpark Unified School District for the proposed grading work on Casey Road; and confirm all private rights of entry for the proposed haul rate. During grading/export operations the applicant shall: Observe normal construction hours allowed by City codes; Regularly water the haul road to eliminate dust at all times and; Cover or water all truck loads prior to leaving the loading area; and comply with all other conditions normally applicable to grading and encroachment permits as required and monitored by the City Engineering and Planning Departments. Staff will condition the permit to require Mr. Burns not begin export operations until the School District has been issued a City grading permit for the proposed work at the school site and that he submit proof to the City that he has been granted right of entry for the proposed haul route. 1 11 1) Approve the request of Burns Pacific Construction to haul approximately 50,000 cubic yards of earth from his property at (APN 500-00-334-22) to the school site on Casey Road subject to the Grading Permit Conditions addressed in this report; and 2) Approve the haul route as shown in Exhibit 1.
