Subject: Consider Minor Modification No. 2 for Development Plan
No. 296, request for a time extension to a Temporary Use
Permit approved for a low speed gliding coaster at
Spectra F /X, 200 Science Drive.
On November 16, 1983 the City Council adopted Resolution No. 83 -55
for construction of a 112,000 sq.ft. industrial building. Minor
Modification No. 1 was approved on April 10, 1984 for a
modification to the exterior elevations.
On November 6, 1995 Zone Clearance No. 95 -262 was issued for
occupancy of the building at 200 Science Drive by Spectra F /X, a
firm which produces rides for amusement parks and special effects
for motion pictures.

On October 9, 1996 the Community Development Department approved
Temporary Use Permit No. 96 -262 for the temporary construction of
a low speed gliding coaster. This coaster is a test unit for a ride
which will be constructed by the applicant at an out of state
amusement park and consists of 550' of track and reaches a height
of 40' -50' in height. This application was approved for a six month
period, expiring on April 9, 1996. The coaster is currently under
construction in the parking lot in the southeast corner of the
site, adjacent to the landscaped slope leading up to New Los
Angeles Avenue. There are 374 parking spaces on the site, of which
the track will occupy 205 spaces. 169 spaces will still be
available for use, which is adequate for the 123 employees. The
track is enclosed by a fence for security purposes (See Attachment
1 for location).
Due to unforseen problems in obtaining the parts from supplier,
Spectra F/X experienced a delay in commencing construction of the
coaster. Due to this delay, completion of construction and testing
of the coaster is not anticipated to be completed prior to the
expiration date of the Temporary Use Permit on April 9, 1997. The
applicant was informed that Section 17.44.030 of the Zoning Code
limits Temporary Use Permits to a period of 180 days. Any extension
past 180 days would require the approval of a Minor Modification by
the City. Minor Modification No. 2 was filed by the applicant on
March 7, 1997.
This request is to modify the approved site plan and conditions of
approval in Resolution No. 83 -55 to permit the low speed gilding
coaster approved in TUP 96 -262 to occupy the parking lot (subject
to conditions of approval) for an additional six months. Section
17.36.050(B -2) of the Zoning Code allows the Director to approve
operations outside the building in the case of operation hardship
or special circumstances, which has been determined to exist for
this request. This Minor Modification request meets all applicable
Zoning Code requirements and has been conditioned to require that:

1) No hazardous materials to be stored or generated on site.
2) Applicant shall provide a six foot security fence around
the perimeter of the test area.
3) All provisions of Sections 17.24060 (lighting) shall apply
to this permit.
4) No existing landscaping shall be removed.
5) Applicant shall provide security for the site on a
continuing basis.
6) All driveways shall remain accessible for public safety
agency vehicles.
7) All requirements of other city departments shall be
complied with, including the Fire Prevention District.
8) This application shall be valid for a period of six months
from the date of approval. Prior to the expiration of the
Minor Modification all materials shall be removed from the
test site and the parking lot area shall restored to its
original condition as required in Development Plan No. 296.
This proposal has been reviewed by the Director of Community
Development who has deferred action to the City Council since that
maximum of six months allowed for Temporary Uses has elapsed.

This project is Categorically Exempt from CEQA requirements as a
Class 1 exemption, for the operation or alteration of private
structures.
Recommend approval of the Attached Resolution approving an
additional six months.

Reference: Temporary Permits for Ride Test Track
Dear Mr. Miller,
First I would like to thank you for taking time out of your busy schedule to meet with us yesterday. We
greatly appreciate the flexibility and understanding you've shown with regards to working with us on
putting up our test track. This is a critical part of our work on this ride and we feel it incumbent upon us
to respond not only to our clients but to be responsible to the city and our neighbors.
Pursuant to our meeting with you we understand that SpectraF/X will be issued a temporary permit which
covers a period of 90(ninety) days with a one time extension for 90(ninety) days. We feel that this time
frame is more than adequate for us to accomplish our goals in testing our ride system.
Per your request, you will find a site plan of the property with placement of the ride test track as well as a
second plan with the area detail. We have included information on the current number of employees and
number of parking spaces available as notes on the site plan. We currently have 123 (one hundred twenty
three) employees. We do not anticipate that this number will change appreciably in the next few months.
Obviously the spaces within the perimeter of the fencing will be gone temporarily. In addition, we have
created a no parking buffer zone on either side of the installation to allow an extra measure of access if
needed. We will have 174 (one hundred seventy four) spaces available for employee and visitor parking
outside of the test and buffer zone. This number includes 8 (eight) spaces for handicapped parking in the
front and on the side of the building. We have also verified that there is a 25 foot access for emergency
access as well as a 16 foot height clearance particularly in the area which we discussed in our meeting.
You will find these measurements indicated on the drawings.
Again, thank you for your time in helping us with this exciting project. We look forward to your visit to
our facility and to working closely with you and the City of Moorpark on this and other exciting ventures

F. Light Fixtures. The following regulations apply to
light fixtures over two (2) feet in height:
1. Maximum height is twenty -four (24) feet (twelve
(12) feet if within one hundred (100) feet of residentially
zoned property) unless a greater height is approved by the
director of community development or his designee.
2. Such fixtures shall not be placed in side setbacks.
3. Lights in excess of one hundred (100) watts shall
not result in direct illumination of adjacent properties.
4. A lighting plan shall be submitted for all approved
entitlement projects governed by Chapter 17.44. The lighting
plan shall achieve the following objectives: avoid interfer-
ences with reasonable use of adjoining properties; minimize
on -site and off -site glare; provide adequate on -site lighting;
limit electroliers height to avoid excessive illumination;
and provide structures which are compatible with the total
design of the proposed facility.
5. Fixtures must provide sharp cut -off qualifies which
minimize light spillage at property lines.
6. Energy - efficient lighting fixtures shall be provided
which are compatible with adjacent properties.
7. No direct light source (bulb) shall be visible from
the road.
8. The architectural design of the pole(s) and lamp(s)
shall complement the design of the building.
9. Eliminate upward light spillage. (Ord. 189 § 3
(8106 -8), 1994)

17.28.010 Purpose.
The purpose of this chapter is to set forth standards and
regulations which apply to proposed uses as listed. (Ord.
189 § 3 (8107 -0), 1994)
17.28.020 Standards relating to dwellings.
A. Antennas, Ground - Mounted. No antenna or mast
shall exceed seventy-five (75) feet in height. The crank -up
variety of ham radio antennas should be used. All units
are encouraged to be color - coordinated to harmonize with
predominant structural background material, so as to reduce
visual impacts. Where feasible, support structures shall

Staff received an application for a Temporary Use Permit from

(until February 1997) for testing purposes a low speed gliding
coaster which runs on a metal track. The circular track is 550'
in length, and will be 40 -50' in height. This track is proposed

Dear Mr. Miller,
As you are probably aware, we are almost at the end of the first 90 day period of our temporary use permit
from the City of Moorpark We have proceeded with fabrication of our test track and we are pleased with
how everything is shaping up. There have, however, been some unforeseeable delays in fabrication which
necessitate our request that we be granted the a 90 day extension on our permit. This will enable us to
continue with our installation and testing.
