SUBJECT: Consider Merit Increase for City Manager
In September 1996, the City Council conducted a
Evaluation" for Steven Kueny, City Manager, for
fiscal year. For the past several years, this

The City Manager, as well as other management employees, is not
covered by formal personnel rules or a Memorandum of Agreement
(MOA). The City Council has historically applied most of the
same rules to management employees including evaluations and
related merit salary increases. While the Brown Act allows
discussion of Performance Evaluations in closed session, it does
not allow discussion of potential salary increases.
The City Council asked the Ad Hoc Compensation Committee (Mayor
Pro Tem Perez and Council Member Wozniak) to discuss this with
the City Manager and to report back to the Council. While the
two items are not directly related, the Committee felt it was
best to defer the merit .increase discussion until more
information about the Compensation Study was received.
In a separate report, the Committee is making recommendations on
implementing compensation adjustments. The City Manager was
eligible for consideration of a merit increase adjustment in July
1995, but he chose not to request an adjustment.
The Committee recommends the following:

A. Change Section 2.12.100 B of the Moorpark Municipal
Code addressing severance pay. The current language
provides for ninety (90) days pay (9 pay periods) if
terminated during the first year of employment and an
additional thirty (30) days pay for each additional
year of continuous service up to a total of 180 days
(18 pay periods). The proposed language would be to
provide four (4) additional weeks of salary and
benefits for each year of service to a maximum of 52
weeks (26 pay periods). Applicable state law currently
allows a maximum of 78 weeks (1 � years) of severance
pay. The Committee has placed the Ordinance revising
this section of the Moorpark Municipal Code on the
agenda of this meeting for first reading.
B. Allow the City Manager to convert up to 40 hours of
accrued vacation leave to deferred compensation each
year. The conversion would be allowed only if he would
still have at least 240 hours of accrued vacation
leave. This allows conversion at the existing rate of
pay without including payment of retirement
contributions. If this accrued leave was still
available when a person leaves City service, it would
be paid out at their then current rate of pay plus
applicable benefit calculations. The Council has the
authority to grant this leave accrual conversion, per
section 2.12.30 of the Moorpark Municipal Code.
RECOMMENDATION
1. Approve 2.56 merit increase with effective date of 7/16/96.
2. Approve on first reading Ordinance amending section
2.12.100 B (Removal from Office).
3. Approve the conversion of 40 hours per year of accrued
vacation leave beyond a 240 minimum vacation leave accrual
to deferred compensation.
