SUBJECT: ADOPT AN URGENCY ORDINANCE EXTENDING ORDINANCE NO. 222
WHICH EXPIRES ON JUNE 30, 1997, AN INTERIM ZONING
ORDINANCE IMPOSING A MORATORIUM ON THE ISSUANCE OF NEW
PERMITS RELATING TO ALCOHOLIC BEVERAGE SALES IN THE CITY,
WITH THE EXCEPTION OF THE DOWNTOWN SPECIFIC PLAN AREA
WHERE CERTAIN STANDARDS CAN BE MET.
On December 26, 1996, the City Council adopted Ordinance No. 222
extending Ordinance No. 221 which established a moratorium on the
issuance of approvals for alcoholic beverage control (ABC) license
request. Ordinance No. 222 will expire on June 30, 1997. As part
of Ordinance No. 222 is direction to the Planning Commission to
study the issue of State Law, City Zoning Code, and City policy
requirements pertaining to the permit and processing requirements
for alcoholic beverage sales in the City.
This staff report has been written to fulfill the requirement for
the issuance of a written report, ten days prior to the expiration
of Ordinance No. 222, describing the measures taken to alleviate
the condition which led to the adoption of the interim zoning
ordinance.
At the meeting of May 12, 1997, Planning Commission considered
Zoning Ordinance Amendment 97 -02 which would require a Conditional
Use Permit for any businesses selling alcoholic beverages and
requiring certain standards for such businesses.
Zoning Ordinance Amendment 97 -02 which recommends permits
standards, and processes to address the issues which led to
adoption of the Interim Urgency Ordinance will also be presented
for City Council consideration on June 4, 1997. If City Council

does introduce first reading on June 4, the ordinance would be
presented for second reading on June 18, 1997 and take effect
thirty days thereafter. This would be subsequent to the expiration
of the current Interim Urgency Ordinance unless extended.
The proposed extension of the Interim Urgency Ordinance also
provides an exception for applications relating to on -site permits
in conjunction with a full - service restaurant which complies with
certain standards and processes. This would address the request
from Mr. Robert Sofsky to the City Council at their meeting of May
7, 1997.
The recommended standards are generally consistent with the
standards proposed with Zoning Ordinance Amendment 97 -02 and also
with standards previously adopted by City policies. The process
provided in the exception would be an Administrative Permit
deferred to City Council which is consistent with processes
previously established by the City. The Zoning Ordinance Amendment
does recommend a Conditional Use Permit process in the future.
It is recommended that the City Council
1. Adopt Ordinance No. , extending Urgency Ordinance No. 222
declaring a moratorium on the issuance of alcoholic beverage
licences through the application of an Administrative Permit,
with the exception of the Downtown Specific Plan area where
certain standards can be met. (Requires a four - fifths vote.)
