HomeMy WebLinkAboutAGENDA REPORT 1997 0604 CC REG ITEM 09GAgenda Report City of Moorpark TO: The Honorable City Council FROM: Paul Porter, Senior Planne0a Nelson Miller, Director of Community DATE: May 21, 1997 (CC meeting of June 4, 1997) A2, r d .9 SUBJECT: CONSIDER REQUEST TO AUTHORIZE MAYOR TO SEND LETTER TO VENTURA COUNTY FLOOD CONTROL REQUESTING THE COUNTY OF VENTURA FLOOD CONTROL DISTRICT (VCFCD) TO INITIATE ACTION BY BOARD OF SUPERVISORS TO NO LONGER REQUIRE RESERVATION OF RIGHT OF WAY FOR ARMY CORPS OF ENGINEERS PROJECT ON 35.23 ACRES ON THE SOUTH SIDE OF LOS ANGELES AVENUE IN THE VICINITY OF MAUREEN LANE AND GOLDMAN AVENUE (RESIDENTIAL PLANNED DEVELOPMENT NO. 96 -1, AND TENTATIVE TRACT MAP NO. 5053) The City has been processing an application filed by Pacific Communities Builder, Inc. for GPA 96 -1, ZC 96 -2, RPD 96 -1 and TR 5053 which will consist of a residential development consisting of 305 dwelling units (123 - 2 bedroom and 172 - 3 bedroom) on 35.23 acres located south and contiguous to Los Angeles Avenue in the vicinity of Maureen Lane and Goldman Avenue (Assessors' Parcel Nos. 506 -0- 030 -135, 145, 155, 165 and 185). The proposed density will be 8.6 units per acre. The proposed project is for an increase of 14 dwelling units from that proposed by the Westland Company. Prior to submittal of the proposed project to the City for review, the applicant and their representatives met with the VCFCD and based on Flood Control Maps designed their project with the required setbacks from the Arroyo Simi. The applicant's project was designed based on County prepared flood control improvement plans for the Arroyo Simi which is smaller in scope than the Army Corps of Engineers project. According to the Environmental Impact Report prepared for the Arroyo Simi Improvements in 1994, the County's improvement Plans reduces the level of flood hazard along Arroyo Simi by increasing channel capacity to convey a 100 year storm event. In addition to enhancing the then level of flood C: \M \RPD961 \4JUN97.CC 1 control protection, the project also reduces the annual maintenance costs to the Arroyo Simi, the loss of land due to bank erosion and channel migration, and sediment transportation to the downstream reaches of the Calleguas Creek and Mugu Lagoon due to bank erosion. For the Villa Campesina project, the VCFCD required an offer of dedication of approximately 78.5 feet of right -of -way between the VCFCD needed right -of -way and the land needed for the County's Flood Control improvements which was for a future Army Corps of Engineers project. The additional land was determined to be suitable by the VCFCD to be used as a recreational area. At the present time, the VCFCD is in the process of determining whether this dedication should be returned to the property owner in fee simple as the additional 78.5 foot dedication is beyond the County's Flood Control improvements. y Subsequent to submittal of the projects to the City, the applicant and their representatives, and the Public Works Director and Director of Community Development from the City met with VCFCD representatives on two occasions and have found that the information given to the applicant initially from the County did not include the required setbacks according to the 1979 Designated Watercourse for Calleguas Creek plan which was adopted by the County on June 12, 1979. This plan was completed based upon a U.S. Army Corps of Engineers project which includes a 400 foot wide channel (200 feet on each side from the proposed centerline of the channel), which exceeds the proposed County project. The net result to the applicant is that requiring an additional 40 feet of property adjacent to the Arroyo Simi would eliminate all of the residential units along the Arroyo Simi. This would ultimately result in a financially less feasible project which will result in a significant loss of affordable dwelling units within the Redevelopment Area of the City. There will be a loss of approximately 18 residential units if additional right -of -way is reserved for the Army Corp of Engineers project. D: \M \RPD961 \4JUN97.CC 2 OW279 With acquiring additional right -of -way for the Army Corp of Engineers project, there would be the potential to provide additional landscaping, recreational trail, natural open space, and /or other recreational opportunities adjacent to the Arroyo. Without the additional right -of -way, sufficient right -of -way would not be available to provide for these additional amenities. Authorize Mayor to send a letter to Ventura County Flood Control requesting Ventura County Flood Control to initiate action by the Ventura County Board of Supervisors to no longer require reservation of additional right -of -way (Designated Watercourse Calleguas Creek {Arroyo Simi)) for U.S. Army Corps of Engineer's project based on the fact it is unlikely the U.S. Army Corps of Engineers project would be constructed in addition to the proposed County project.
