Which Will be Lost with the Implementation of Proposition 218
BACKGROUND
At the June 18, 1997 meeting of the City Council, the Council discussed the projected
impacts of the implementation of Proposition 218 on the City's two existing assessment
districts (Assessment District 84 -2 - the Lighting and Landscape Maintenance Assessment
District and Assessment District 85 -1 - the Parks Maintenance Assessment District). In the
absence of definitive implementing legislation from the State Legislature (which could be
several years in coming), staff presented the Council with the most recent available
interpretations of Proposition 218.
DISCUSSION
After general discussion, the City Council directed staff to prepare the necessary
resolutions to call for an election for the potential imposition of a parcel tax within the City
of Moorpark which would fund the maintenance and operations of the City's parks. Staff
has provided four options which the Council may consider while discussing the appropriate
level of the proposed parcel tax (please see Attachment "A" for the four options).
The rate categories are the same as those used in calculating the assessments under the
former Parks Maintenance Assessment District.
Please also note that the language proposed in the four Exhibits "A" to the proposed
resolution calling for the election are illustrative only. The final language of the measure
is currently being drafted by the City Attorney.
RECOMMENDATION
That the City Council direct staff as deemed appropriate.

Option 1
Option 1 takes the current parks maintenance assessment, adds 5% for contingency and potential
increased costs and then assumes that the City general fund will absorb any future increases. This
holds the parks maintenance assessment constant at $637,277. Over ten years it is estimated that
1.6 million dollars will need to be absorbed by the general fund.
This option does not include the cost of maintaining the community center, senior center and
arroyo vista park. For fiscal year 1997/1998 this amounts to $117,181 and over ten years will
amount to 1.5 million dollars.
The parcel tax for a single family home would be $58.44.
Option 2
Option 2 takes the current parks maintenance assessment and also adds the maintenance of the
community center, senior center, and arroyo vista recreation center. It also adds 5% for
contingency and potential cost increases for next fiscal year and then holds the amount constant
for ten years with the general fund absorbing the cost increases. The general fund would need to
absorb 1.96 million dollars.
The parcel tax for a single family home would be $69.72.
Option 3
Option 3 differs from Option 1, in that the cost for the current parks maintenance assessment
district is projected to grow 5% a year and the requested parcel tax revenue authority is set at the
tenth year level. The Council would only assess each year the amount necessary to cover the
costs for that year, but the authority would be available to increase costs to the limit.
With this option the community center, senior center and arroyo vista park would be funded by
the general fund. The cost is estimated to be 1.5 million dollars.
The parcel tax for a single family home would be $90.66.
Option 4
Option 4 requests funding authority to include the community center, senior center and arroyo
vista park maintenance. There would be no impact to the general fund with this option. The
Council would only tax the amount needed to provide the service, but would have the authority to
tax at the ten year projected tax rate.
The parcel tax for a single family home would be $108.16.

SUBJECT: Additional Information Related to the Council's Consideration of Calling
an Election on November 4, 1997 to Replace Revenues Which Will be
Lost with the Implementation of Proposition 218
Attached are four draft resolutions which the Council may consider while discussing the
various options related to the loss of the parks maintenance assessment district revenues
as a result of Proposition 218. These draft resolutions supplement the information
provided to the Council earlier, copies of which are attached hereto for ease of reference.
The resolutions and the four options prepared by staff are meant to provide a basis for
discussion by the Council. The Council may wish to adopt one of the options as
presented, adopt an option with amendments, or take other action. The City Attorney is
currently revising the proposed resolutions and preparing the boilerplate language of an
ordinance which would be placed before the voters for their approval, should the Council
choose to call an election.
The final language of the resolution(s), exhibit(s), and ordinance(s) will be determined by
the City Attorney based upon the direction provided by the Council.
RESOLUTION NO. 97-
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK,
CALIFORNIA, REQUESTING THE BOARD OF SUPERVISORS OF VENTURA
COUNTY TO PERMIT THE COUNTY CLERK TO RENDER SERVICES TO THE CITY
OF MOORPARK FOR THE SPECIAL MUNICIPAL ELECTION TO BE HELD ON
NOVEMBER 4, 1997 AND TO CANVASS THE RETURNS OF THE SPECIAL
MUNICIPAL ELECTION.
WHEREAS, a Special Municipal Election is to be held in the City of Moorpark, California
on November 4, 1997 for the purpose of submitting a question or measure to the qualified
electors of the City approving a parcel tax; and,
WHEREAS, pursuant to Section 10002 of the Elections Code, the City of Moorpark wishes
to have the County Clerk of Ventura County render specified services to the City relating
to the conduct of the election; and
WHEREAS, the City of Moorpark authorizes the Board of Supervisors of Ventura County
to direct the County Clerk to canvass the election returns of the Special Municipal Election
to be held in the City of Moorpark on November 4, 1997.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK DOES
HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS:
SECTION 1. That pursuant to the Elections Code, the Board of Supervisors is requested
to permit the County Clerk to render services with respect the conduct of the Special
Municipal Election, as shown on Exhibit "A," attached hereto and made a part hereof; and
that any and all other such services be rendered as may be necessary to complete the
election.
SECTION 2. That the County Clerk of said County is hereby authorized to canvass the
returns of said Special Municipal Election.
SECTION 3. That the City of Moorpark recognizes that additional costs will be incurred
by the County by reason of these services being rendered and agrees to reimburse the
County for any such costs.
SECTION 4. That the City Clerk of the City of Moorpark is hereby directed to file a certified
copy of this Resolution with the Board of Supervisors of the County of Ventura.
SECTION 5. That the City Clerk shall certify to the passage and adoption of this
Resolution and shall enter it into the book of original Resolutions of said City.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK,
CALIFORNIA, CALLING AND GIVING NOTICE OF THE HOLDING OF A SPECIAL
MUNICIPAL ELECTION TO BE HELD IN THE CITY ON TUESDAY, NOVEMBER 4,
1997 FOR THE SUBMISSION OF A QUESTION OR MEASURE TO THE QUALIFIED
ELECTORS OF THE CITY TO APPROVE ADOPTING A PARCEL TAX IN
ACCORDANCE WITH THE PROVISIONS OF THE REVENUE AND TAXATION CODE
SECTION AND REQUESTING THE BOARD OF SUPERVISORS OF THE
COUNTY OF VENTURA TO CONSOLIDATE SAID MUNICIPAL ELECTION WITH
THE STATEWIDE GENERAL ELECTION ON SAID DATE PURSUANT TO SECTION
10401 OF THE ELECTIONS CODE
WHEREAS, under the provisions of the laws relating to general law cities in the State of
California, a Special Municipal Election shall be held on November 4, 1997 to submit to
the voters a question or measure relating to the imposition of a parcel tax.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA,
DOES RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS:
SECTION 1. That pursuant to the requirements of the laws of the State of California
relating to General Law Cities within the State, there is called and ordered held in the City
of Moorpark, California, on November 4, 1997, a Special Municipal Election for the
purpose of submitting to the qualified electors of the City the question or measure as
attached in Exhibit "A."
SECTION 2. That the notice of the time and place of holding the election is given and the
City Clerk is authorized, instructed and directed to give such further or additional notice
of the election, in time, form, and manner required by law.
SECTION 3. That the ballots to be used at the election shall be, in form and content, such
as may be required by law to be used in the election.
SECTION 4. That the polls for the election shall be open at seven o'clock a.m. (7:00 a.m.)
of the day of the election and shall remain open continuously from that time until eight '
o'clock p.m. (8:00 p.m.) of the same day, when the polls shall be closed, except as
provided by law for holding municipal elections in the City.
SECTION 5. That pursuant to the requirements of Section 10401 of the Elections Code,
the Board of Supervisors of the County of Ventura is hereby requested to consent and
agree to the consolidation of said Municipal Election with the Statewide General Election
on Tuesday, November 4, 1997.
SECTION 6. That said Board of Supervisors is hereby requested to issue instructions to
the County Clerk to take any and all steps necessary for the holding of said consolidated
election.
SECTION 7. That in all particulars not recited in this Resolution, the election shall be held
and conducted as provided by law for holding municipal elections in the City.
SECTION $. That the City Clerk of the City of Moorpark is hereby directed to file a certified
copy of this Resolution with the Board of Supervisors and the County Clerk of the County
of Ventura.
SECTION 9. That the City Clerk shall certify to the passage and adoption of this
