Mr SUBJECT: Consider AB 1296 (Morrow) Skateboarding and AB 915 (Baugh) Rollerblading - Hazardous Recreational Activities. BACKGROUND The City Council is being asked to consider expressing its support for AB 1296 and AB 915. AB 1296 would add skateboarding to the list of hazardous recreational activities for which cities enjoy limited liability protection and AB 915 would also add rollerblading (in -line skating) to the same list of activities. If enacted, persons 18 years or older who are injured while rollerblading or skateboarding will have little legal recourse to sue local agencies for inappropriate "duty of care" or negligence, as the risks associated with these activities is exclusively assumed by the adult participant and outweighs any contributory negligence on behalf of an agency. Currently, for participants under 18 years of age, the parent or guardian assumes responsibility for the risks associated with participation in said activities. Both bills provide the necessary protection to encourage local agencies to expand these recreational opportunities in safe physical environments without assuming liability. The bills described above are being presented to the City Council because the particular subject matter is not addressed in the City Council adopted legislative program. RECOMMENDATION Staff recommends that the City Council support AB 1296 and AB 915 and direct the Mayor to write a letter to the appropriate Legislative Committee expressing the City's position. 1 000151
