Traffenstedt, Assistant City Manager DATE: 08/15/2018 Regular Meeting SUBJECT: Consider Resolution Amending the City’s Salary Plan and Rescinding Resolution No. 2018-3717 BACKGROUND Attached to this report is a draft resolution amending the City’s Salary Plan, with changes shown with the use of legislative format. The amended Salary Plan includes a two percent (2%) cost-of-living increase for all Competitive Service employees consistent with a new two-year Memorandum of Understanding (MOU) with Service Employees International Union (SEIU) Local 721, which is a separate agenda item for the August 15, 2018 regular meeting. The new MOU is intended to be adopted first, prior to City Council adoption of a revised Salary Plan Resolution. DISCUSSION The Salary Schedules attached to the Salary Plan Resolution are divided into three separate sections for the Hourly Positions, Competitive Service Positions, and Non- Competitive Service Positions. The three separate Salary Schedule sections for the Hourly Positions, Competitive Service Positions, and Non-Competitive Service Positions have Hourly, Bi-weekly, and Monthly salary tables for each established salary step and range. Only the Competitive Service Positions Salary Schedule tables have been revised in the attached resolution to incorporate a negotiated 2% cost-of-living increase for employees represented by SEIU, since the Hourly and Non-Competitive Service Positions Salary Schedule tables were previously revised to incorporate the 2% cost-of- living increase through the adoption of Resolution No. 2018-3717 at the City Council’s June 20, 2018 regular meeting. The Competitive Service Positions Salary Schedule tables in the attached revised Salary Plan Resolution include a retroactive 2% cost-of- living increase for the pay check dated July 27, 2018 (which is the pay period beginning July 7, 2018), consistent with the MOU agreement. The final resolution will not include the legislative format, which has been added to show the revisions for City Council consideration. Item: 10.K. 180 Honorable City Council 08/01/2018 Regular Meeting Page 2 GOVERNMENT CODE SECTION 54953(C)(3) ANNOUNCEMENT Government Code Section 54953(c)(3) is not applicable, since the Competitive Service positions are not considered local agency executives per the State law definition, and the current changes to the Salary Plan Resolution only affect the Competitive Service positions. FISCAL IMPACT The overall estimated cost of the proposed changes to the Salary Plan for Competitive Service employees is approximately $43,000 for Fiscal Year 2018-19. The Salary Plan increase for the Competitive Service employees will be retroactive to the pay period beginning July 7, 2018, which is the pay check dated July 27, 2018. The effective date of the increase in pay is consistent with what was previously implemented for the Hourly and Non-Competitive Service employees, as approved at the City Council’s June 20, 2018 regular meeting. The adopted Fiscal Year 2018-19 Budget did not incorporate the 2% cost-of-living increase for all employees. As described in the Fiscal Year 2018-19 Budget adoption agenda report, there is a budget surplus. A Budget amendment resolution will be scheduled for consideration at the Council’s September 5, 2018 regular meeting to fund the 2% cost-of-living increase for all employees. STAFF RECOMMENDATION ROLL CALL VOTE 1. Adopt Resolution No. 2018-____, rescinding Resolution No. 2018-3717; and 2. Direct staff to schedule a budget amendment resolution for the City Council’s September 5, 2018 regular meeting to fund the approved Fiscal Year 2018-19 cost-of-living increase for all employees. Attachment: Draft Salary Plan Resolution including Attachment A, Salary Schedules 181 RESOLUTION NO. 2018-3717 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, AMENDING THE SALARY PLAN FOR COMPETITIVE SERVICE, NON-COMPETITIVE SERVICE AND HOURLY EMPLOYEES, AND RESCINDING RESOLUTION NO. 2018-3684717 WHEREAS, the City Council at its regular meeting on June 20, 2018, considered and adopted an amended Salary Plan to incorporatethat included a two percent (2%) cost- of-living salary increase for the Non-Competitive Service and Hourly positions in the attached Salary Schedule Tableseffective with the pay check dated July 27, 2018; and, and to delete reference to grandfathered longevity pay language that is no longer applicable for some positions. WHEREAS, the City Council at its regular meeting on August 15, 2018, considered and adopted an amended Salary Plan to also incorporate a two percent (2%) cost-of-living salary increase for the Competitive Service positions into the attached Salary Schedule Tables effective with the pay check dated July 27, 2018, and prior to approval of a revised Salary Plan Resolution authorized retroactive pay in the Memorandum of Understanding with SEIU Local 721, approved by the City Council on August 15, 2018. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. The corresponding salaries for the ranges established in Section 1 of this resolution are attached hereto and incorporated herein as the “Hourly Salary Schedule” Table. The Bi-Weekly Salary for each range may be calculated by multiplying the Hourly Salary by two thousand eighty (2,080) hours and dividing that calculation by twenty six (26) pay periods. The Monthly Salary for each range may be calculated by multiplying the Hourly Salary by two thousand eighty (2,080) hours and dividing that calculation by twelve (12) months. The Annual Salary for each range may be calculated by multiplying the Hourly Salary by two thousand eighty (2,080) hours. The “Bi-Weekly Salary Schedule” and “Monthly Salary Schedule” attached to this resolution are for information purposes, only, since calculations are approximate due to rounding differences. SECTION 3. The Salary Plan is based on ranges of two and one-half percent (2.5%) and step increases of two and one-half percent (2.5%) with a total of thirteen (13) steps. SECTION 4. City shall continue to pay a deferred compensation contribution into a City approved deferred compensation program, for enrolled regular full-time and regular part-time employees, and the contribution amount shall be as follows: City Manager - Three percent (3.0%) of gross base salary, Department Head positions – two and one-half percent (2.5%) of gross base salary, and all other Management and Competitive Service regular full-time and regular part-time positions – Two percent (2.0%) of gross base salary. Gross base salary is defined as wages paid as described in the Salary Plan Schedule (reference Section 2, herein) and including longevity pay; and excluding bilingual pay, in- lieu insurance payment, uniform cleaning allowance, leave cash-out, overtime pay, car and cellular telephone allowances, and deferred compensation payment. A Retired Annuitant is not eligible for a deferred compensation contribution. SECTION 5. Bilingual pay compensation for Spanish language bilingual skills shall be paid to qualified regular full-time and part-time employees, consistent with the qualification requirements approved in a Memorandum of Understanding (MOU) between the City of Moorpark and the Service Employees International Union CTW , CLC, Local 721, and to qualified non-competitive service employees consistent with a City Council adopted management benefits resolution. Qualification for bilingual pay shall be determined by the City Manager at his or her sole discretion. The current rates per an approved MOU and management benefits resolution are: forty cents ($.40) per hour for verbal bilingual pay, for all hours actually worked, and including annual leave, vacation leave, City holidays, and sick leave, but not for disability leave or other unpaid leave, for up to forty (40) hours per week; and fifty cents ($.50) per hour for combined verbal/written bilingual pay, for all hours actually worked, and including annual leave, vacation leave, City holidays, and sick leave, but not for disability leave or other unpaid leave, for up to forty (40) hours per week. A Retired Annuitant is not eligible for bilingual pay compensation. 185 Resolution No. 2018-3717 Page 5 SECTION 6. Longevity pay compensation shall be paid to qualified regular full-time employees hired prior to January 1, 2015, consistent with the qualification requirements approved in a Memorandum of Agreement between the City of Moorpark and the Service Employees International Union CTW , CLC, Local 721 as follows: 121 to 180 Months of service – one-percent (1%), 181 to 240 Months of service – one and one-half percent (1.5%), 241 to 300 Months of service – two percent (2.0%) 301 or more Months of service – two and one-half percent (2.5%); and Longevity pay compensation shall be paid to qualified Non-Competitive Service employees hired prior to January 1, 2015, consistent with the qualification requirements approved in a City Council adopted management benefits resolution as follows: Department Heads 61 to 120 Months of service – one percent (1.0%) 121 to 180 Months of service – one and one-half percent (1.5%) 181 to 240 Months of service – two percent (2.0%) 241 to 300 Months of service – two and one-half percent (2.5%) 301 or more Months of service – three percent (3.0%) Management Employees 121 to 180 Months of service – one percent (1.0%) 181 to 240 Months of service – one and one-half percent (1.5%) 241 to 300 Months of service – two percent (2.0%) 301 or more Months of service – two and one-half percent (2.5%). Retired Annuitant Not eligible for longevity pay compensation. SECTION 7. Implementation of salary adjustments for positions noted in Section 1, herein, shall be limited by the performance review system. Employees shall be evaluated prior to their anniversary date, and approved salary adjustments shall be effective as of the first day of the pay period in which the anniversary date occurs. A Retired Annuitant is not eligible for merit raise salary adjustments pursuant to a performance review system, based on the limited term of the Retired Annuitant appointment. SECTION 8. Resolution No. 2018-3684717 shall be rescinded in its entirety, and this revised Salary Plan Resolution shall become effective upon adoption, and the attached Salary Schedule Tables shall all be effective with the pay period beginning July 7, 2018,. The effective dates on the attached Exhibit A Salary Schedule Tables have been revised to reflect the effective and the pay check date of July 27, 2018. 186 Resolution No. 2018-3717 Page 6 SECTION 9. The City Clerk shall certify to the adoption of this resolution and shall cause a certified resolution to be filed in the book of original resolutions.
