ACTTON:_ I " q -7 -- t '� -7 Z TO: The Honorable City Council FROM: Paul Porter, Principal Planne6'' Nelson Miller, Director of Community Developmenotd*A_ DATE: August 19, 1997 (CC meeting of September 3, 1997) SUBJECT: CONSIDER APPROVAL OF MINOR MODIFICATION NO. 2 TO PLANNED DEVELOPMENT PERMIT NO. 1055 LOCATED AT 216 MOORPARK AVENUE ON THE APPLICATION OF COMMUNITY CHRISTIAN CHURCH TO ALLOW FOR CHURCH USES OF THE ENTIRE BUILDING WITH THE EXCEPTION OF THE AREA CURRENTLY LEASED BY THE CALIFORNIA HIGHWAY PATROL, AND AUTHORIZATION TO ALLOW 50% OF THE REQUIRED PARKING REQUIREMENT TO BE LOCATED OFF -SITE. The applicant has requested approval to allow for church uses of the entire existing building with the exception of the area currently being leased by the California Highway Patrol located at 216 Moorpark Avenue, and to authorize 50 percent of the required parking to be located off -site. On May 14, 1986, the Planning Commission adopted Resolution No. PD 86 -97 approving Planned Development Permit No. PD -1055 approving a 14,340 square foot L- shaped office /commercial building on the subject property. Minor Modification No. 1 to the Planned Development permit was approved by the Director of Community C: \M \PD1055M1 \3SEP97.CC Minor Mod 2 to PD 1055 Community Christian Church City Council Staff Report 9/3/97 Page No. 2 Development on December 18, 1989 to allow changes in the architectural elements, treatment, colors and materials in order to enhance the building character. On August 15, 1997, Community Christian Church applied for Minor Modification No. 2 to PD 1055 requesting permission to utilize the existing building for combined office and church uses. The property is located at 216 Moorpark Avenue and the existing improvements include the existing two story building, associated parking and landscaping areas. The current use of the building is for office uses with 1,492 square feet being leased to the California Highway Patrol along with exclusive use of six parking spaces. The church proposes to continue with the office space lease, utilizing the balance of the building for the Community Christian Church. The sanctuary will be on the second floor with fixed seating for 200, with Sunday school rooms and offices on the first floor. worship services on Sunday will begin between 8:30 and 9:30 a.m. with children's classes to be held during adult worship time. Another worship service may be added in the future if the need exists. If additional services are added, the worship times will be staggered so that people have sufficient time to leave for the incoming people to have sufficient available parking. Sunday evenings there will be Youth Groups meeting at the facility and possibly worship services from time to time. In addition, quarterly family functions will be planned on Sunday evenings. Staff will be working out of the offices and there will be ongoing counseling during the weekday and evening hours in addition to bible studies. The applicant has indicated that once the church grows to capacity, they will begin a second worship service spaced properly enough from the first service to give people a chance to leave the facility before the second service begins. The facility will be used most of the day on Sunday for services, bible classes and youth programs. Weddings that will be performed in the worship area will normally take place on Saturdays. During weekdays, the office facility will be used by pastoral staff, secretaries, and volunteers helping with administrative tasks. The church staff has two pastors and one secretary. There are also a few occasions during the year, the church puts on children's programs such as Vacation Bible Classes and parent /children programs that will meet during the week. The church will only utilize on -site parking during the weekdays. In order to ensure sufficient on -site parking during the weekdays, the following condition of approval has been placed on the project: Activities or other uses during normal weekday business hours shall be limited to an occupancy load which will require the use of no more than the parking spaces located on -site. Evening programs that will meet during the week include bible studies, support groups and choir practices as well as Pastor's counseling in the Pastoral offices. Typically, the office hours will be from 9:00 a.m. to 5:00 p.m. with Bible Studies beginning from 7 -8:00 p.m. until 9 -9:30 p.m. in the inside educational section of the building. The office is typically closed on Mondays. According to Section 17.32.010j. of the City's Municipal Code, churches and similar structures are required to have the following parking requirements: 1 space for every 4 fixed seats, plus 1 space per 28 square feet of area in main auditorium (sanctuary or place of worship) not occupied by permanent seats. In addition, the rooms for Sunday school, offices and other undesignated space requires 1 space for each 300 square feet. The following is a summary of the available and required parking for the proposed church which includes a maximum of ten spaces for use by the California Highway Patrol: Sanctuary 2,957 1 per 4 seats 50 spaces 200 seats Sanctuary area with no seating 500 1 per 50 sq. Ft. 3.9 TOTAL 14,340 PARKING PROVIDED: 49 ON -SITE 47 OFF -SITE 96 TOTAL 96 SPACES Section 17.32.060 B of the Municipal Code allows uses to utilize off - street parking on adjacent parcels and states as follows: B. Location. Off - street parking spaces shall be located on the same lot as the building or use that they are to serve. Off - street parking may be provided off -site if all of the following apply and if the decision - making authority allows it: 1. Such off - street parking is located within five hundred (500) feet of the property to be served; and C: \M \PD1055M1 \3SEP97.CC 000291 Minor Mod 2 to PD 1055 Community Christian Church City Council Staff Report 9/3/97 Page No. 5 2. The amount of off -site parking satisfies not more than fifty percent (50 %) of the parking requirements of the activity for which the parking is provided; and 3. The site of the parking lot is in the same ownership as the principal use, or is under a recorded lease with the use that provides that the parking will exist as long as the use it serves, unless the parking is replaced with other spaces that satisfy the requirements of this chapter; and 4. The parking lot is not located in a residential zone; and 5. The use benefitting from this off -site parking shall cease when the off -site parking is no longer available. In this case, the church meets the intent of Section (b) of the Ordinance Code which requires that the church property have at least 50 percent of the required number of parking spaces. The applicant indicated that they will be able to lease approximately 65 parking spaces located at the Moorpark School District property which is not presently being leased to the Methodist Church. The Methodist currently uses the parking at the Flory School site. This project has been conditioned to demonstrate that there is a lease agreement which allows the applicant to have the total required parking spaces as required by the City's Municipal Code. The parking shall be provided for the duration of the permit and shall be reflected in the lease agreement between the lessor and the lessee of the property. The use of the building as a church will expire if the required parking is not continued to be provided as agreed upon. However, the school property is residentially zoned which could be construed as being in conflict with No. 4 above which states that the parking lot is not located in a residential zone. The Council can determine that the requirement regarding not allowing the off - site parking to be in a residential zone would not apply in this C: \M \PD1055M1 \3SEP97.CC 000292 Minor Mod 2 to PD 1055 Community Christian Church City Council Staff Report 9/3/97 Page No. 6 case since the school district property is an institutional use and not occupied or planned for residential dwellings. Pursuant to City policy, this Minor Modification is being deferred to City Council for review.
