HomeMy WebLinkAboutAGENDA REPORT 1997 0903 CC REG ITEM 09HAGENDA REPORT CITY OF MOORPARK TO: The Honorable City Council ITEiVI 7• 14 0 CRY OF MOORPAR& CALIFORNIA City CC7il Meeting of � 199 � ACTION: " BY•� —� FROM: Paul Porter, Principal Planne Nelson Miller, Director of Community Developme DATE: August 22, 1997 (CC meeting of 9/3/97) SUBJECT: CONSIDER INTERIM POLICY TO ALLOW DIRECTOR OF COMMUNITY DEVELOPMENT TO APPROVE MINOR EXCEPTIONS FROM CODE FOR ALLOWING A TEN PERCENT REDUCTION IN THE REQUIRED LOT SIZE FOR A SECOND DWELLING UNIT On May 7, 1997, the City Council adopted a Resolution to authorize the initiation of proceedings to consider revisions to Chapter 17.44 of the Municipal Code (Entitlement - Process and Procedures) to provide for an Administrative Exception whereby applications for minor exceptions and adjustments of zoning regulations may be approved by the Director of Community Development. At the time, the Council, in response to a circumstance relating to Tract 4174 (Wayne Colmer), approved an interim policy to allow the Director of Community Development to approve a decrease /increase of up to ten percent (100) for required minimum setback, lot coverage and wall heights upon making findings of good cause. At the meeting of August 20, 1997, an item was requested regarding the request of Mr. Joe Martinez for a second dwelling unit which had an inadequate lot size. On August 16, 1996, Joe Martinez submitted an application for Administrative Permit No. 96 -18 requesting approval for construction of a room addition and a second dwelling unit located at 14421 Avenida Colonia. The 530 sf. second dwelling unit proposed two bedrooms, a bathroom, and a closet. C:\M\ZOMD.973\3SEP97.CC C: \M \ZOAMD.973 \3SEP97.CC 000315 Zoning Ordinance Amendment No. 97 -3 City Council Staff Report of September 3, 1997 Page No. 2 Section 17.28.020G1a of the Municipal Code (Second Dwelling) states that a second dwelling shall only be permitted on a residential zoned lot that is one fourth acre (10,890) square feet or larger. On March 14, 1997, after several efforts to resolve the issue, the Department of Community Development sent Mr. Martinez a letter approving a proposed room addition, but denying the proposed second unit, indicating the 10,672 sf. lot is too small. Providing for an Administrative Exception and an interim policy to allow for a reduction in lot size in certain instances would serve to reduce the delay and cost to an applicant and the City in connection with minor exceptions to the Zoning Ordinance and would allow for minor reductions where findings for a variance may not be warranted. If Council desires to establish an interim policy to allow for a reduction in lot size for second dwelling units, staff will address this issue as part of the Administrative Exception Code Amendment which will also include the interim policy of a 10% decrease /increase for setbacks, lot coverage and wall heights upon the Director of Community Development making findings of good cause. Mr. Martinez would need to file an application for an Administrative Permit for reconsideration of his request and notification of surrounding property owners. 1. Approve the reduction in lot size to allow for the second dwelling unit and authorize the Director of Community Development to approve a Minor Exception and a new Administrative Permit without further Council review. 2. Approve an interim policy for 5% reduction in lot area for second dwelling units, in addition to the existing policy of allowing the Director of Community Development to approve a decrease/ increase of up to ten percent (10 %) for required minimum setback, lot coverage and wall heights upon making findings of good cause.
