Subject: Consider Approval of Minor Modification No. 1 to Major
Modification No. 1 to Development Plan No. 318 on the
application of Kavlico Corp. for construction of a canopy
at 14401 E. Los Angeles Avenue (APN 513 -0- 010 -210)
Background
Development Plan No. 318 Major Modification No. 1 was approved by
the City Council on February 3, 1993 for construction of a 91,549
square foot industrial building. This building is located adjacent
to Development Plan 318, a 130,288 sq.ft. industrial building which
was approved on November 4,1985. Both buildings are occupied by
Kavlico. The project site is located in the Redevelopment Project
Area.

Project Description
This Minor Modification request is for the construction of a canopy
in the rear of the building which will be used to protect products
being delivered to Kavlico from rain and sun.
Discussion
Construction. The canopy will be 2,758 sq.ft. in size, measuring
25' x 1101411, height of 171611, constructed of metal with four
columns and a corrugated roof, and be painted to match the existing
building. A portion of the canopy, as well as the parking lot,
extends into an easement for a below grade flood control channel.
On September 8, 1997, the County of Ventura Flood Control District
granted permission for construction of the canopy above the flood
control easement.
Parking. This building requires the provision of 259 parking spaces
(including handicapped ) . At present, 261 spaces are provided on
site, including 10 motorcycle spaces. Motorcycle spaces may
substitute for required parking spaces at a rate of two motorcycle
spaces for one regular space, reducing the number of required
spaces from 259 to 254. Construction of the canopy and the
attendant storage location will result in the elimination of 14
parking spaces, reducing the spaces provided on site from 261 to
247, seven spaces below the minimum required. Staff will require
that the site plan be revised to provide seven additional parking
spaces prior to approval of a Zone Clearance for construction of
the canopy. These seven parking spaces must be built prior to
completion of the canopy.
The delivery of products into the building will be through the two
existing 12' wide truck loading doors in the rear of the building.
Parking of the trucks and the unloaded products will occur in the
existing parking spaces and aisles, eliminating their use.
Building Modifications. No modifications are proposed to* the
exterior of the building, besides the canopy.

Circulation. Construction of the canopy will affect the circulation
pattern on the site by providing an additional loading site behind
the building in addition to the existing truck loading docks. This
new site adjacent to the building will eliminate parking spaces and
the driving aisles. Ingress and egress of trucks to the proposed
site would not be hindered by the site configuration. The frequency
of deliveries will not be affected.
Noise. Most industrial developments receive deliveries by truck as
an approved accessory use, not as a principal use itself. This
Minor Modification will not result in an increase the noise levels
on either the subject or adjacent properties through an increase in
traffic due to deliveries (which are already occurring on the
site) .
Landscaping. Additional landscaping will be required to screen the
loading area as described in the next paragraph.
Visibility. The canopy would be screened on the west side by a
hill, from Los Angeles Avenue on the east side by the two Kavlico
buildings and on the south due to the distance to Los Angeles
Avenue (7201) and elevation differences. The canopy would be
visible from freeway on the north side. Staff will require the
addition of landscaping to screen the loading zone adjacent to and
under the canopy, consisting of a hedge of large shrubs (six to
eight feet in height) and additional trees in the planter adjacent
to the north side of the canopy and loading area (which separates
the two buildings). Items being unloaded will not be left outside
on a permanent basis. In addition, Condition No. 23 of Resolution
93 -914 (which approved the building) prohibits outside storage
without screening and Condition 63 prohibits the outside storage of
materials. Applicant has submitted a letter stating that the canopy
will not be used for outside storage.
Staff recommends approval of this Minor Modification application
with the Findings and conditions in the attached Resolution.

Environmental Determination
This project is Categorically Exempt from CEQA requirements as a
Class 3 exemption, for the construction of accessory structures.
Recommendation
Adopt the attached Resolution approving Minor Modification No. 1 to
Development Plan Permit No. 318 Major Modification No. 1.

RESOLUTION NO. 97-
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK,
CALIFORNIA, APPROVING MINOR MODIFICATION NO. 1 TO MAJOR
MODIFICATION NO. 1 TO DEVELOPMENT PLAN NO. 318 ON THE
APPLICATION OF KAVLICO CORP. FOR CONSTRUCTION OF A 2,758
SQ.FT. CANOPY AT 14401 E. LOS ANGELES AVENUE (ASSESSOR
PARCEL NO. 513 -0- 010 -210)
WHEREAS, on August 19, 1997, the applicant applied for Minor
Modification No. 1 to Major Modification No. 1 to Development
Plan No. 318; and
WHEREAS, the Director of Community Development referred the
matter to the City Council on October 15, 1997; and
WHEREAS, at its meeting of October 15, 1997 the City Council
considered the application filed by Kavlico Corp., requesting
approval of Minor Modification No. 1 to Major Modification No. 1
to Development Plan No. 318 for construction of a 2,758 sq.ft.
canopy at 14401 E. New Los Angeles Avenue; and
WHEREAS, at its meeting of October 15, 1997, the City
Council after review and consideration of the information
contained in the staff report dated September 26, 1997, reached a
decision on this matter.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK,
CALIFORNIA, DOES RESOLVE AS FOLLOWS:
SECTION 1. Based upon the information and findings presented
in the staff report and accompanying documents, and public
testimony, the City Council finds that:
a. The project is Categorically Exempt from CEQA
requirements as a Class 3 exemption, construction of an
accessory structure;
b. The proposed project would not have a substantial -
adverse impact on surrounding properties;

C. The Minor Modification is consistent with the intent
and provisions of the City's general Plan and of the
City Ordinance Code;
d. The Minor Modification is compatible with the character
of surrounding development;
e. The proposed Minor Modification would not be obnoxious
or harmful, or impair the utility of neighboring
property or uses;
f. The Modification would not be detrimental to the public
interest, health, safety, convenience, or welfare; and
g. The proposed project is compatible with existing and
planned land uses in the general area where the
development is to be located.
SECTION 2. The City Council conditionally approves Minor
Modification No. 1 to Major Modification No. 1 to Development
Plan No. 318 for construction of a canopy.
SECTION 3. Approval of Minor Modification No. 1 to Major
Modification No. 1 to Development Plan No. 318 is hereby approved
subject to the following conditions:
1. Approval of a Zoning Clearance and Building Permit is
required prior to construction. Applicant shall meet
all permit requirements of the Building and Safety
Department.
2. Prior to approval of Zone Clearance, applicant shall
modify the site plan to provide for the construction of
seven additional parking spaces. These parking spaces
shall be constructed prior to the completion of the
canopy.

3. Applicant shall provide additional landscaping to
include a hedge of large shrubs (six to eight feet in
height) and additional trees in the planter adjacent to
the north side of the canopy and loading area (which
separates the two buildings) to screen the loading
areas. This landscaping shall be approved by the
Director of Community Development and shall be
installed prior to completion of the canopy.
4. Prior to approval of the Zone Clearance, the site plan
shall be revised to depict the loading zone adjacent
to the canopy.

7. No outside storage of any materials or overnight
parking of any semi-trucks or truck trailers beyond the
loading zones shall be permitted.
8. All proposed and existing lighting shall comply with
Section 17.24.090 F o the Zoning Code and conditions
of approval of DP 318 Any revisions to the lighting
shall require the prior approval of the Director of
Community Development.
9. Section 17.36.040 of the Zoning Code prohibits lighting
from a industrial SitE onto adjacent streets.

11. The Director of Community Development may declare a
development project that is not in compliance with the
conditions of approval or for some other just cause, a
"public nuisance ". The applicant shall be liable to the
City for any and all costs and expenses to the City
involved in thereafter abating the nuisance and in
obtaining compliance with the conditions of approval or
applicable codes. If the applicant fails to pay all
City costs related to this action, the City may enact
special assessment proceedings against the parcel of
land upon which the nuisance existed (Moorpark
Municipal Code Section 1.12.080)
12. The applicant and successors, heirs, and assigns shall
remove any graffiti within five (5) days from written
notification by the City of Moorpark. All such graffiti
removal shall be accomplished to the satisfaction of
the Director of Community Development.
13. The continued maintenance of the landscaping, permit
area, and facilities shall be subject to periodic
inspection by the City. The permittee shall be required
to remedy any defects in ground maintenance, as
indicated by the Code Enforcement Officer within thirty
(30) days after notification.
14. All conditions of approval in Resolution No. 85 -249 and
93 -914 apply unless amended by this Resolution.
15. Prior to completion, the applicant shall request the
City to enforce appropriate vehicle codes on the
subject property as permitted by Vehicle Code Section
21107.7.

SECTION 4. The City Clerk shall certify to the adoption of
this Resolution.

The proposed project to add a canopy to the rear of our building located at 14401 Los
Angeles Ave is for loading and unloading of vehicles during the rainy season. It is
specifically designed to protect our product and production parts during the loading and
unloading process for shipping and receiving. There is no intent to use this area for long
term storage other than the for the reasons cited above.
