HomeMy WebLinkAboutAGENDA REPORT 1997 1015 CC REG ITEM 09HAGENDA REPORT CITY OF MOORPARK 71�o.9 IFORNTA _--_ 199 L ACTION : /V TO: THE HONORABLE CITY COUNCIL BY FROM: DIRK LOVETT, ASSISTANT CITY ENGINEER (Prepared by Chris Oberender, Associat Engineer) DATE: OCTOBER 8, 1997 (MEETING OF OCTOBER 15, 1997) SUBJECT: CONSIDER SOIL EXPORT REQUEST AND ALTERNATE HAUL ROUTE (PAUL BURNS) BACKGROUND The applicant (Paul Burns) previously requested the City to allow him to export approximately 50,000 cubic yards of earth to the proposed elementary school located at Casey Road. At its March 19, 1997 meeting the City Council approved his request. Since that time, the School District has negotiated the import of all the fill material it needs to complete the work at Casey Road from another source. As a result, the applicant is requesting that he be allowed to haul the material to an alternate location, yet to be determined. Because no new export site has been confirmed, Mr. Burns requests that the material be transported south on Gabbert Rd.to Los Angeles Avenue and then proceed either east on Los Angeles Avenue to SR -23 or west on Los Angeles Avenue out of the City (see Exhibit 1). The proposed alternate haul routes will provide the applicant the flexibility to negotiate contracts for destinations outside the City limits of Moorpark. Staff estimates that there will be about 4,200 truck trips associated with this haul operation. DISCUSSION Staff has reviewed the applicant's grading plan and is prepared to issue a grading /export permit as soon as a destination for the export material is known by the applicant. Use of the proposed haul route will utilize Gabbert Road only, minimizing truck traffic on City streets. It is standard practice to require a surety for such operations, not only for on -site grading but for clean -up and potential repair to City streets. In addition to the grading surety, staff recommends that a $10,000 surety be submitted for any necessary repairs or street sweeping required on Gabbert Road. In addition staff recommends that the permit be valid for a period of one year from the Council's approval . Following are staff's recommended conditions: owlao Grading /Encroachment Permit Conditions Prior to the issuance of a Grading /Export and Encroachment Permit the applicant shall: Submit a $10,000 cash deposit or other security, approved by the City, for any necessary cleaning or street repairs to Gabbert Road; Receive city approval for an erosion control plan which addresses all implementation measures at all stages of excavation during the term of the permit; notify City Engineering of the export destination(s) and days during which the operation will be occurring; and pay an inspection deposit of $1,000 to cover the inspection time required for City staff to monitor the operation. During grading /export operations the applicant shall: Observe normal construction hours allowed by City codes, except that haul times shall be limited from 9:00 A.M. to 3:00 P.M., on days when school is in session, with no haul occurring on Saturdays, Sundays or Holidays; The permit shall carry a one year time limit with one 6 month extension available, as approved by the City Engineer and Director of Community Development, provided the application for extension occurs prior to expiration of the 1st year; Regularly water the applicant's site to eliminate dust; cover or water all truck loads prior to leaving the loading area; sweep the City street daily or as requested by the City; Erosion Control Measures shall be implemented during the rainy season from October 15 - April 15; and comply with all other conditions normally applicable to grading and encroachment permits as required and monitored by the City Engineering and Planning Departments. STAFF RECOMMENDATION 1. Approve the request of Burns Pacific Construction to haul approximately 50,000 cubic yards of earth from his property at (APN 500 -00- 334 -22) to a yet to be determined site, subject to the Grading /Encroachment Permit Conditions outlined in this report; and 2) Approve the haul route alternates as shown in Exhibit 1 Burns Haul /MAC 7200 VVVJLU.
