Subject: Consider Request to Import and Stockpile 20,000
cubic yards of soil to Tentative Tract 5053
(Pacific Communities)
Background
On October 2, 1997 the City received a request from the subject
property owner's representative, Urban Strategies, to import and
stockpile approximately 20,000 cubic yards of earth from the
Carlsberg development (see attached letter). The Pacific
Communities site is situated between Los Angeles Avenue on the
north, the Arroyo Simi on the south, Liberty Bell Rd. on the east
and Maureen Lane on the west. As of this date no Tentative Map
has been approved for the Pacific Communities site but the
tentative map application did indicate that roughly 14,500 cubic
yards of soil would be needed as import to grade the site. The
developer's engineer has informed city staff that the total amount
to grade the site must be increased to about 40,000 cubic yards
due to a report of unconsolidated organic materials which also
require removal.
Developer's of Carlsberg Tract 4973 and 4974 are presently
constructing large water lines in the future Science Drive right
of way. The excess soil from this construction needs to be
exported before construction on the road can continue.
Approximately 20,000 cubic yards of soil are proposed to be
imported to the future Pacific Communities site from the Carlsberg
development. Pacific Communities representatives have not
determined where the other 20,000 cubic yards will come from.
The applicant has submitted a proposed stockpile plan for the
future site. (Exhibit A).
Discussion
Pacific Communities has indicated that it is their plan to go
forward with developing the property as a single family
residential project. The starting construction date is uncertain
because of ongoing negotiations with the Flood Control District
concerning improvements to adjacent facilities at the Arroyo Simi.

Due to the immediate availability of soil, it is the applicant's
desire to receive and stockpile the material until the project is
approved. After project approval it is the applicant's intent
that the grading plan utilize the material as part of their
grading and site improvements. As such, the applicant has
requested they be allowed to temporarily stockpile the soil for an
indefinite period.
The proposed location of the stockpile will be the easterly
portion of the proposed residential site. The maximum height of
temporary fill will be approximately 3 feet and staff feels that
the appearance of this stockpile, as viewed from Los Angeles
Avenue and the surrounding areas, will be insignificant.
Positive drainage south to the Arroyo Simi will be provided. An
erosion control plan has not been submitted but will also be
conditioned as part of this approval.
Although no trees are identified in the stockpile plan, some
Pepper trees so exist. It is therefore recommended that any trees
within the stockpile area be protected by limiting the grading to
outside the driplines, Staff will also have the developer's
arborist confirm no adverse effect to the trees from this
requirement prior to the permit being issued.
A proposed truck haul route has been identified. Trucks will exit
tract 4974 at a location approximately 1000 feet south of the
Peach Hill /Spring Road intersection. From there trucks will
proceed north on Spring Road to Los Angeles Avenue and then go
west on Los Angeles Avenue directly to the site. Although the
applicant has requested that hauling of soil commence immediately
upon Council authorization, all clearances, permits or other forms
of approval must be obtained prior to the commencement of any
work.
A similar request was recently considered and approved by the City
Council for the Marketplace Properties site at the northwest
corner of Spring Road and Tierra Rejada Road. As such, similar
conditions and procedures will be recommended with this request
where applicable.
Grading plan check fees and inspection deposits will be required
based on the yardage of soil imported. A surety is also typically
required for such work, based on cost, should the City have to
remove the soil or finish the grading if the developer is unable
to. The estimated cost to remove and export the stockpile or
repair city property, if necessary, is estimated to be $120,000
plus a 10% contingency. However, as with the Marketplace request,
the developer has requested that they only be required to bond for
the spreading and compaction of the soil - not for import /export.
It is the applicant's contention that there will be no need to
export the soil because the site will need this material for
future development, even if the applicant is unable to finish

grading or if the property is developed by others. By excluding
the cost of import /export the surety would be reduced to $48,000
plus a 10% contingency.
It is staff's opinion that the stockpile, as proposed, is not high
enough to create a noticeably abrupt or unstable feature. As
such, it is unlikely that the City would have to export the
material even if the current owner is not capable of spreading and
compacting the soil after it is imported and stockpiled. The
surety would provide resources for the City to spread and compact
the soil if deemed necessary for any reason.
If the City Council approves the requested import and stockpile
staff recommends requiring the following conditions:
Special Conditions
• Prior to the commencement of export operations the applicant
shall obtain a zone clearance, grading and encroachment
permits and shall pay all standard planning, plan check, and
inspection fees for the zone clearance, plan review and
permit issuance.
• A revised grading plan shall be resubmitted by which the
stockpile slopes shall not exceed 4:1 and showing the grading
within the stockpile area not encroaching into the driplines
of any trees. (Subject to staff communication with the
developer's arborist indicating no adverse effects on the
trees will occur).
• Applicant shall submit a surety equal to $10,000 for the
cleaning and repairs of City streets.
• Applicant shall submit a surety equal to $48,000 plus 100
contingency for spreading and compaction only - not for
export of soil. The surety shall remain in place until such
time that final site grading has been completed, certified
and approved by the City Engineer.
• The stockpile area shall be sandbagged and seeded for erosion
and dust control per the erosion control plan, which is to be
reviewed and approved by the City Engineer and Director of
Community Development prior to issuance of a grading or
encroachment permit.
• The applicant shall submit a revegetation plan to the
Director of Community Development for review and approval.
This plan shall be receive approval prior to issuance of a
grading or encroachment permit.
• Applicant shall submit a cash deposit in the amount of $5,000
for revegetation purposes. This deposit shall be released
upon satisfactory revegetation of the stockpile area, per the
Director of Community Development.
• All hauling operations shall be limited to the hours of 9:00
a.m. - 3:00 p.m. on schooldays, with no haul occurring on
Saturdays, Sundays or Holidays.
• Flagman shall be available, as determined by the City
Engineer, at the access point with Spring Road.

• All streets shall be cleaned daily or as requested by the
City Engineer.
• All foundations, concrete slabs or other concrete structures
in the stockpile area shall be removed prior to the placement
of material.
Summary
Due to the immediate availability of soil from the Carlsberg site
and the need for soil at the Pacific Communities site, the
applicant is requesting that they be allowed to import and
stockpile 20,000 yards of soil for an indefinite period. This
soil is proposed to be used for future site development by the
applicant after a grading plan is approved and a grading permit is
issued. The applicant anticipates that construction may commence
early next year.
Standard encroachment permit fees, grading plan check fees,
inspection deposits and sureties will be required for the import
and stockpile. The applicant, however, requests that they not be
required to provide surety for the transportation cost of
exporting /importing soil, since it is unlikely that the City would
have to export the soil even if the present owner does not develop
the site.
Recommendation
1. Approve the import and stockpile of 20,000 yards of soil as
shown in the attached stockpile plan, subject to and as
revised pursuant to the conditions contained herein; and
2. Approve the reduction of surety to exclude export and import
costs.

Subject: Tentative Tract 5053 /Carlsberg
Dear Mr. Lovett:
Tentative Tract 5053 has an opportunity to acquire up to 20,000 cubic yards of dirt, which
will be needed for the project, from the Carlsberg grading area. Carlsberg has an excess
of approximately that amount.
This letter is to request approval for the dirt to be placed on the tentative tract 5053 site
until such time as grading will begin for this tract.
Enclosed is the spreading plan for the site. Hauling will occur on Los Angeles Avenue
and enter on to the site via the private drive 150 ft. east of Shasta.
