SUBJECT: Consider Resolution No. 98 - Enabling the
Enforcement of the California Vehicle Code on Science
Drive [Carlsberg: Tracts 4973, 4975, 4976, 4977 and 4980
DISCUSSION
Science Drive, between New Los Angeles Avenue and Tierra Rejada
Road (see the Resolution attached as Exhibit 1 for location), has
not yet been accepted by the City as a public street. Said street
segment will technically remain a private street until accepted by
the City.
This segment of Science Drive is or will soon be opened for public
use. Traffic laws cannot be enforced on this private road unless
and until the City Council adopts a resolution, pursuant to Section
21107.5 of the California Vehicle Code (CVC), making said private
road subject to the provisions of the CVC.
CVC Section 21107.5 does not require the consent of the owner
(developer) of a street not yet accepted by the City, in order to
take action to make the street subject to the provisions of the
CVC. However, said CVC Section does require that a public hearing
be held on the matter prior to taking action, and that the property
owner be notified of said hearing at least ten (10) days prior to
said hearing. A public hearing for this purpose has been scheduled
for this date, and the owner(s) of the properties within which this
street segment is located [Tracts 4973, 4975, 4976, 4977 and 4980
-- see Exhibit 1] was provided ten (10) day advance notice of this
public hearing.
Staff recommends that the City Council adopt Resolution No. 98- _
(Exhibit 1) finding Science Drive between New Los Angeles Avenue
and Tierra Rejada Road, to be subject to the provisions of the CVC.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF MOORPARK, CALIFORNIA, FINDING AND DECLARING
SCIENCE DRIVE BETWEEN NEW LOS ANGELES AVENUE
AND TIERRA REJADA ROAD, TO BE SUBJECT TO THE
PROVISIONS OF THE CALIFORNIA VEHICLE CODE
[CARLSBERG: Tracts 4973, 4975, 4976, 4977 &
4980]
WHEREAS, Science Drive, between New Los Angeles Avenue and
Tierra Rejada Road, as generally shown on Exhibit 'A" attached
hereto and made a part hereof , has not yet been accepted by the
City as a public street, and is, therefore, considered to be a
private road; and,
WHEREAS, this segment of Science Derive is or will soon be held
open for public use and is so connected to adjacent highways that
the public cannot determine that said private road is not a public
street; and,
WHEREAS, the traffic laws of the State and the City cannot be
enforced on said private road being held open for public use,
unless and until action is taken by the City Council pursuant to
Section 21107.5 of the California Vehicle Code (CVC), making said
private road subject to the provisions of said Code; and,
WHEREAS, said private road is located within Tracts 4073, 4975,
4976, 4977 and 4980; and,
WHEREAS, a public hearing has been held on the matter and the
owner of said Tracts was notified of said public hearing at least
ten (10) days prior to the date of said hearing.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK,
CALIFORNIA, DOES HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS:
SECTION 1. That Science Drive, between New Los Angeles Avenue
and Tierra Rejada Road, shall be subject to the provisions of the
CVC.
SECTION 2. That this resolution shall take effect
immediately.
PASSED AND ADOPTED this 15th day of July, 1998.
