Reynolds Jr., Administrative Services Manager BY: � �A- DATE: July 8, 1998 SUBJECT: Consider Revisions to the City's Police Service Rates and False Alarm Billing Rate Summary The following report requests Council consideration for an increase to the City's rate charged for police services, and an increase to the City's flat rate for false alarm billings (adoption of the Resolution provided in Attachment "A "). These increases are a reflection of increases passed to the City from the County of Ventura Sheriffs department. The last revisions to the service rate was made in January 1997, and the last revision to the false alarm billing rate was made in 1993. Service Rates The City established rates for police services with the adoption of Resolution 92 -868, on July 15, 1992. This resolution adopted police rates for the purpose of recovering all City costs associated with the review and development of permit conditions associated with new development projects, traffic control, crowd control, inspection of special events, emergency responses and other specific police related services. The requirement to advertise and hold a public meeting prior to adopting or increasing development fees, (Government Code 66061), is not applicable because these fees only apply to the recovery of costs related to government regulatory action or approvals. This fee will apply specifically to the review of a development plan by the Community Services Officer in the Police Department, the development of temporary use permit conditions for special events (including such applications as film permits, carnivals, and craft fairs), staffing special events, and emergency cost recovery, when the emergency is caused by an illegal activity and can be collected through the District Attorney's Office. Resolution 92 -686 based the cost of the Police Service Rate on the following elements: County Sheriffs direct cost to the City, or base rate; a portion of the support staff costs; the facility costs; equipment, and; contract management. When calculating "all" costs, the cost generally rose to more than 100% of the cost charged to the City for special event applications. Since 1992, this approach has not changed. The City has only increased the service rate by the percentage increase which occurs annually to the base contract rate charged to the City. These are the increases shown in Attachment "B." False Alarm Billing Rate The police respond to alarms related to buildings and structures on a routine basis and 000140 occasionally these occur as a result of human or equipment failure, and not from a crime in progress or illegal entry. Currently, after the third false alarm in any 365 day period, a fifty dollar fee is charged, increasing up to $500 per response as needed. Each time a false alarm occurs, a new twelve month period beings. A review of the False Alarm billing rates in Section "2" of Exhibit "A" of the resolution, includes both the average increase in police contract rates over since 1993, and compared the flat rates applied in other neighboring cities. The sum of the average increase in police contract rates since 1993 equals 12.47°/x. The City of Camarillo does not have this fee. Thousand Oaks applies a $55 rate after the third response in the calendar year, then $110, and $150 with a $550 cap. Simi Valley applies a $74 rate after five false alarms in any 365 consecutive day period, adding $74 to each thereafter. Staff is recommending a ten percent increase, from $50 to $55, and an increase of the cap from $500 to $550, which is the same as the current rate applied in Thousand Oaks. Recommendation That the City Council adopt Resolution No. 98- establishing approval of Police Service Fees for FY 1998/99, and rescinding Resolution No. 97 -1273. Attachment: A) Resolution No. 98- B) Rate Calculation r 000.1,p RESOLUTION 98 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, ESTABLISHING APPROVAL OF POLICE SERVICE FEES AND RESCINDING RESOLUTION 97- 1273 WHEREAS, it is appropriate for the City to establish fees for City police services which are not of benefit nor the responsibility of the - public -at- large; and WHEREAS, the City contracts for police services with the County of Ventura; and WHEREAS, the City uses police personnel for development plan review, traffic control, crowd control, special event permit review, inspection, emergency responses and other police services from time -to -time; and WHEREAS, these services are for the benefit of or precipitated by the actions of private individuals or companies and the expense is not appropriately the responsibility of the public -at- large; NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, DOES HEREBY RESOLVE, DETERMINE, AND ORDER AS FOLLOWS: SECTION 1. All police service fees and charges shall be reviewed and updated annually by the department as part of the budget process to ensure that they are current and are related to actual cost. SECTION 2. That City Resolution 97 -1273 is hereby rescinded. SECTION 3. That the City Council hereby approves the fee schedule attached as Exhibit "A" - Police Service Fees.
