SUBJECT: Consider Resolution No. to Establish a Bail Schedule for Violations of the
Municipal Traffic Code, Which Apply to Vehicle Parking
EXECUTIVE SUMMARY
This presents for City Council consideration, a resolution rescinding the bail schedule established
by Council in March 1993, and establishing a new schedule for violations of the municipal traffic
code relative to vehicle parking. All penalties for violations on the prior schedule (except for
parking in a disabled person space) were $30.00 each. The new proposed schedule sets these
penalties at $40.00 each and leaves the penalty for parking in a disabled person space unchanged
at $280.00.

A. Background
In 1984, the City of Moorpark adopted its own municipal code sections addressing parking
violations. These sections allow Moorpark Police and Parking Enforcement officers to cite
the Moorpark Municipal Code rather than the California Vehicle Code when parking
infractions occur. Since 1984, the City has retained the majority of fines collected for
parking violations (except for the 1991 State /County Surcharge of $5.00 per citation)
because of Council's action creating the municipal traffic code.
The bail schedule for parking violations in the City of Moorpark has remained essentially
unchanged since July 1991. In March 1993 Council did increase the disabled person
parking penalty to $280.00 and added new $30.00 penalties to address vehicles blocking curb
cuts and ramps designed for disabled persons. All other violation penalties on the schedule
remained set at $30.00, as they had been since July 1991.

B. Request
Pursuant to a recommendation by the Budget and Finance Committee - members: Mayor
Hunter and Council member Wozniak - staff surveyed parking citations issued by the three
major cities surrounding the City of Moorpark (see Exhibit "B ").
C. Findinsas
Average bail amounts for the adopted schedule of parking violations, exclusive of penalties
related to parking, blocking or obstructing a "Disabled Person" space, for the three
surrounding cities are:

Moorpark's current bail schedule falls 26.3% below the average of surrounding cities.
Selection of a uniform $40.00 penalty for violations of all sections of the Moorpark
Municipal Traffic Code would be consistent with Thousand Oaks' approach.
RECOMMENDED ACTION
Staff recommends that City Council adopt Resolution No. 98- establishing a new bail
schedule for violations of the municipal traffic code which apply to vehicle parking.

RESOLUTION NO. 98 -
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
MOORPARK, CALIFORNIA, RESCINDING RESOLUTION
93 -924, AND ESTABLISHING A BAIL SCHEDULE FOR
VIOLATIONS OF THE MUNICIPAL TRAFFIC CODE,
WHICH APPLY TO VEHICLE PARKING
WHEREAS, The City Council of the City of Moorpark desires to increase bail amounts for
parking violations in the City of Moorpark to be more reflective of bail amounts applied in the cities
surrounding Moorpark
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK,
CALIFORNIA, DOES HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS:
SECTION 1. Resolution 93 -924 is hereby repealed effective immediately.
SECTION 2. That all infractions of the Moorpark Municipal Traffic Code which apply to
vehicle parking, as listed in Exhibit "A" be subject to payment of a bail amount as specified therein.
SECTION 3. That all infractions of the Moorpark Municipal Traffic Code which apply to
vehicle parking, as listed in Exhibit "A" which are not paid to the City of Moorpark within 10 days
of the mailing of the notice of parking violation, shall be subject to a ten dollar late charge, in
addition to the established bail amount referred to in Section 1 of this resolution.
SECTION 4. That this Resolution shall be effective and operative immediately.
