SUMMARY:
Consider Minor Modification No. 1 to Amendment 1 of Specific Plan
92-1 (Simi Moorpark Freeway Properties) , request to allow a
temporary rock crushing on site to provide rock base material for
road improvements .
LOCATION:
The proposed site is approximately one and a half acres of the
Specific Plan site which totals 488 acre . The rock crusher will
be located adjacent to the 23 Freeway, approximately 500 ' south
of New Los Angeles Avenue . The Assessor Parcel Numbers are 513-
0-050-110 and 170 . The property involved in this request is not
located within the boundaries of the Redevelopment Agency.
BACKGROUND AND PRIOR ACTIONS:
On September 7, 1994, the City Council adopted Resolution No. 94-
1061 approving Specific Plan 92-1, an application from Simi
Moorpark Freeway Properties for the construction of 552 single
family homes on 155 acres, 73 acres of Commercial/Business Park
and 6 . 5 acres of park space on a 488 acre parcel located north of
Tierra Rejada Road, east of Spring Road, south of New Los Angeles
Avenue and west of the 23 Freeway.

DISCUSSION:
The request is to permit a rock crushing to be located on site
and operated (subject to conditions of approval) for a period of
six months . Section V.B. 1X of the Specific Plan allows the
Director to approve "Any proposed change that is not extensive
enough to be considered a substantial or fundamental change in
land use relative to the permit, would no have a substantial
adverse impact on surrounding properties, and would not change
any findings contained in the environmental document prepared for
the permit, shall be deemed a minor modification and be acted
upon by the Director of Community Development in accordance with
applicable procedures for minor modifications" . Although this use
is not listed as an allowed use in Section 17 . 20 . 05/06 of the
code, it can be allowed as a temporary use as a related
construction activity and temporary storage of building
materials . This Minor Modification request meets all applicable
Zoning Code requirements and has suggested conditions of approval
have been included in the attached draft Resolution.
On July 6, 1998 , Minor Modification No. 1 to Specific Plan 92-1
was filed to allow rock crushing within the boundaries of the
Carlsberg Specific Plan area on a temporary basis . The proposed
site is located adjacent to the 23 Freeway, 500 ' south of New Los
Angeles Avenue, on the southern boundary of the recently graded
73 acre commercial/business park site. The equipment measures 50 '
x 250 ' with an adjacent material stockpile area measuring 250 ' x
450 ' . The maximum height of the equipment is 25 ' , which will be
partially screened from view due the 70 ' height of the 23 Freeway
adjacent to the subject site .
The rock used on the site mainly comes from the D.W. Burhoe
quarry located at 9218 Los Angeles Avenue, in an unincorporated
part of the County near Grimes Canyon Road. Access to the subject
site is from New Los Angeles Avenue (Science Drive entrance) ,
turning right to enter the site and turning right when exiting to
access New Los Angeles Avenue and the 23 Freeway.

This proposed equipment will be used to crush rocks trucked in to
the site (a maximum of 12 trucks per hour) which will be used as
a base materials used in the construction of the backbone streets
of the project : New Los Angeles Avenue, the remainder of Science
Drive and Spring Road. The commencement of construction of the
north portion of Spring Road been delayed after until September
1, 1998 . The maximum output of the equipment is 3 , 000 tons of
material per day. An estimated total of 130, 000 to 150, 000 tons
will be necessary for completion of the backbone streets of the
development .
The developer has encountered a shortage of available rock base
material (see Attachment B) and is requesting consideration of
this application to insure a steady supply of these materials
compared to relying on off-site suppliers which might not
guarantee supplies .
The proposed hours of operation are from 7 : 00 am to 7 : 00 pm,
Mondays through Fridays . Applicant is proposing the equipment be
used for a period of six months in duration, at which time the
crusher will be removed and the site will be cleaned up. No off
site use of the rocks, or sales , or use of the rocks by any party
other than the applicant is allowed.
The City is interested in insuring the completion of Science
Drive and development of the infrastructure in a timely fashion.
Conditional approval of this request and the Zone Clearance for
the rock crusher will facilitate this result .
This proposal has been reviewed by the Director of Community
Development who has deferred action to the City Council .
Conditions have been recommended to limit the hours of
operations, the maximum time not to exceed six months, impose
noise limitations at the property line, to control dust, limit
air quality impacts, and limit the use to this project only.

ENVIRONMENTAL ASSESSMENT:
Pursuant to the California Environmental Quality Act (CEQA) , an
evaluation has been conducted to determine if the proposed
project could significantly affect the environment . It has been
determined that the request is Categorically Exempt as a Class 4
exemption for the minor alteration of land as a minor temporary
use . In addition, the Environmental Impact Report and approved
resolution provided mitigation measures for construction
activities for the development .
Recommendation:
Adopt Resolution No . 98- approving Minor Modification No . 1
to Specific Plan 92-1 .

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
MOORPARK, CALIFORNIA, APPROVING SPECIFIC PLAN 92-1
MINOR MODIFICATION NO. 1 ON THE APPLICATION OF SIMI-
MOORPARK FREEWAY PROPERTIES FOR A TEMPORARY USE OF A
ROCK CRUSHER ON THE SPECIFIC PLAN 92-1 SITE, ASSESSORS
PARCEL NO'S. 513-050-110 AND 170 .
WHEREAS, on July 6, 1998, the applicant applied for
Specific Plan No. 92-1 Minor Modification No. 1 and
WHEREAS, the Director of Community Development referred the
matter to the City Council on July 15, 1998 ; and
WHEREAS, at its meeting of July 15, 1998 , the City Council
considered the application filed by Simi Moorpark Freeway
Properties, requesting approval of Minor Modification No. 1; and
WHEREAS, at its meeting of July 15, 1998 , the City Council
after review and consideration of the information contained in
the staff report dated July 15, 1998 reached a decision on this
matter; and
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK,
CALIFORNIA, DOES RESOLVE AS FOLLOWS:
SECTION 1. Based upon the information and findings presented
in the staff report and accompanying documents, and public
testimony, the City Council finds that :
a: The project is Categorically Exempt from the California
Environmental Quality Act requirements as a Class 4
exemption for the minor alteration of land as a minor
temporary use .
b. The Minor Modification is consistent with the intent and
provisions of the City' s General Plan and of the City
Ordinance Code;
c . The Minor Modification is compatible with the character of
surrounding development;

d. The proposed Minor Modification would not be obnoxious or
harmful, or impair the utility of neighboring property or
uses;
e . The Permit would not be detrimental to the public interest,
health, safety, convenience, or welfare; and
f . The conditionally permitted use is compatible with existing
and planned land uses in the general area where the
development is to be located.
g. The proposed project would not have a substantial adverse
impact on surrounding properties .
SECTION 2 . The City Council conditionally approves Specific
Plan 92-1 Minor Modification No. 1 for temporary operation of
rock crusher.
SECTION 3 . Approval of Specific Plan 92-1 Minor Modification
No. 1 is hereby approved subject to the following conditions :
1 . Approval of an Electrical Permit is required for all
lighting. All provisions of Sections 17 . 24 . 090 of the
Municipal Code shall apply to this permit to insure that
lighting minimizes on and off-site glare and have sharp cut
off qualities .
2 . All conditions of approval of Specific Plan 92-1 and
Resolution 94-1061 apply, unless modified by this
Resolution.
3 . All streets and driveways used to access the site shall
remain accessible for public safety agency vehicles .
4 . All requirements of other City departments shall be complied
with, including the Fire Prevention District, Air Pollution
Control District and Environmental Health.

5 . This application shall be valid for a period not to exceed
six months from the date of approval . Prior to the
expiration of the Minor Modification all equipment and
materials shall be removed from the site which will shall be
restored to its original condition and appropriate erosion
control measures applied to the site . Applicant shall post a
bond with the City sufficient to insure removal of all
equipment and material and implementation of erosion control
measures, subject to approval of the City Engineer and the
Director of Community Development .
6 . All equipment and other noise generation sources on-site
shall be attenuated not to exceed 65 dEA at the property
line, or to the ambient noise level at the property line
measured at the time of the occupant request . The Director
of Community Development may request that a noise study be
submitted for review and approval which demonstrates that
all on-site noise generation sources would be mitigated to
the required level . The noise study must be prepared by a
licensed acoustical engineer in accordance with accepted
engineering standards .
7 . During construction, operation and removal of the rock
crusher, dust shall be controlled by regular watering. In
addition the following measures shall apply:
a. Water the site and all access roads to prevent
excessive amounts of dust . Watering shall occur a
minimum of at least two times daily, preferably in the
late morning, after the completion of work for the day,
and using recycled water if available . Additional
watering for dust control shall occur as directed by
the City.
b. Cease all rock crushing operations if airborne dust is
created during periods of high winds (greater than 20
mph averaged over one hour) . The contractor shall
maintain contact with the Air Pollution Control

District (APCD) meteorologist for current information
about average wind speeds .
c . Water or securely cover all material transported off-
site and on-site to prevent excessive amounts of dust .
d. Keep all operation and construction equipment on or
near the site, until these activities are completed.
e . The area disturbed by operation of the rock crusher
shall be minimized to prevent excessive dust
generation.
f . Wash off heavy-duty construction vehicles before they
leave the site .
g. Apply non-hazardous chemical stabilizers to all
inactive portions of the site .
h. Periodically, or as directed by the City Engineer,
sweep public streets in the vicinity of the site to
remove silt (i .e . , fine earth material transported from
the site by wind, vehicular activities, water runoff,
etc . ) which may have accumulated from construction
activities .
8 . All diesel engines used in construction or operation
equipment shall use reformulated diesel fuel .
9 . During smog season (May-October) the City shall order that
operation or construction cease during Stage III alerts to
minimize the number of vehicles and equipment operating,
lower ozone levels and protect equipment operators from
excessive smog levels . The City, at its discretion, may
also limit operation or construction during Stage II alerts .
10 Operations shall be limited to between the following hours :
a) 7 : 00 a.m. and 7 : 00 p.m. Monday through Friday.

11 . Truck noise from hauling operations shall be minimized
through establishing hauling routes which avoid residential
areas and requiring that "Jake Brakes" not be used along the
haul route within the City. The hauling route must be
identified as part of the grading plan and shall be approved
by the City Engineer.
12 . The applicant shall ensure that all equipment is fitted with
modern sound reduction equipment .
13 . Equipment not in use for more than ten minutes shall be
turned off .
14 . If any hazardous waste is encountered during the
construction or operation of this project, all work shall be
immediately stopped and the Ventura County Environmental
Health Department, the Fire Department, the Sheriff ' s
Department, and the City Construction Observer shall be
notified immediately. Work shall not proceed until
clearance has been issued by all of these agencies .
15 . The applicant shall utilize all prudent and reasonable
measures (including installation of a 6-foot high chain link
fence around the construction sites or provision of a full
time licensed security guard) to prevent unauthorized
persons from entering the work site at any time and to
protect the public from accidents and injury.
16 . Equipment engines shall be maintained in good condition and
in proper tune as set forth in manufacturers specifications .
17 . Truck noise from hauling operations shall be minimized
through establishing hauling routes which avoid residential
areas . The hauling plan must be approved by the Director of
Community Development prior to approval of a Zone Clearance .
18 . All vehicles on the site shall observe a 15 mile per hour
speed limit .

19 . A maximum of twelve (12) truckloads per hour average to and
from the site is allowed.
20 . No materials generated by the equipment shall be used off-
site or given or sold to any party other than the applicant .
21 . Approval of a Zone Clearance is required prior to the
construction of the equipment or start of operation.
SECTION 4 . The City Clerk shall certify to the adoption of
this Resolution.

Carlsberg Ranch
Dear Nelson:
Submitted herewith you will find an application and filing fee for a Minor Modification, seeking approval
to allow rock crushing on property commonly referred to as the Carlsberg Ranch.
The undersigned seeks your approval of the Minor Modification to allow rock crushing in order to create
the necessary street base material for road improvements (both public and private) conditioned upon the
Carlsberg Ranch. The requested rock crushing is not to be a commercial operation wherein base material
will be manufactured and sold to outside third parties. The term of the rock crushing operation will not
exceed six(6) months
As I have verbally explained to you, it is becoming increasingly more difficult to find base material in close
proximity to the Carlsberg Ranch. Alternative base material would have to come from as far away as
Bakersfield, which is costly, inconvenient, and unpredictable as to supply.
In order to timely fulfill our responsibilities to complete our road improvements, a predictable supply of
base material is needed. Therefore, we are requesting approval of a rock crushing operation, characterized
by the following criteria:
1 The term of the rock crushing shall not exceed six (6) months from the date we are
able to proceed. The rock crushing machinery will be off the site at the end of 6
months.
2. The type of trucks to be used to deliver suitable material to the site for crushing
will be 5-axle semi-end dump trucks.
3. There will be no more than twelve(12)trucks per hour delivering suitable material
to the site.
4 Estimated hours of operation would take place between 7:00 am and 7:00 pm,
Monday through Friday. No crushing will take place on the weekends.
5. Truck traffic delivering material will come from eastbound traffic on New Los
Angeles Avenue, entering at Science Drive.

Trucks exiting the site will do so via the Science Drive intersection, eastbound to
the freeway.
There will be no left turns allowed onto or off of New Los Angeles Avenue to or
from the site.
6. The location of the crushing equipment will be adjacent to the Moorpark Freeway
as depicted on the attached site plan, in an area of the site that is intended to be less
visible from the freeway. We would be agreeable, however, to work with Staff
concerning another location if this would be your desire.
7. The crushing equipment will occupy an area approximately 250 feet by 250 feet,
and will stand a maximum height of 35 feet. Also attached hereto you will find
photographs of typical rock crushing equipment.
8 The stockpile area will be approximately 250 feet by 450 feet, which we anticipate
to be located as close to the freeway as possible.
9 Dust control will be provided during the hours of operation.
10 It is anticipated that approximately 3,000 tons of street base can be created per day
once the crushing equipment is fully operational.

Dear Craig:
With reference to the undersigned's application for a Minor Modification to conduct rock
crushing upon the Carlsberg Ranch property, you have asked several questions concerning our
proposed operation. The following restates the questions and contains our response:
What is the decibel reading at approximately 15 meters during the operation of the
rock crusher? Noise tests from similar equipment that we intend to use registers
78.4 decibels at 15 meters(approximately 50 feet).
What is the elevation of the Moorpark Freeway and New Los Angeles Avenue in
relation to the proposed location of the rock crushing equipment? The Moorpark
Freeway is approximately 70 feet above the rock crushing equipment and New Los
Angeles Avenue is approximately 30 feet above the equipment, assuming its
proposed location depicted on the site plan. For your additional information, the
equipment will be located approximately 500 feet south of New Los Angeles
Avenue.
Where is the location of the crushable material? Most of the material to be
crushed will come from property located at 9218 Los Angeles Avenue, Ventura
County. Notwithstanding the above, all material to be delivered to the crushing
equipment will come via eastbound traffic on New Los Angeles Avenue. There
will be no left turns into or out of the Carlsberg Ranch property onto New Los
Angeles Avenue.
How much road base do we need? It is anticipated that approximately 130,000-
150,000 tons of road base will be needed for Spring Road, Science Drive, and
New Los Angeles Avenue improvements. We further anticipate to manufacture
another 50,000-100,000 cubic yards of road base for the Business Park
development and/or Lennar Homes' development in order to take advantage of the

presence of the rock crusher and to eliminate truck traffic to and from the site with
further construction.
You will also be receiving from Mr. David Coles, eight (8) sets of new color copies of the type of
compact portable rock crusher we are proposing to use. This unit is powered by a portable
generator and is smaller than the equipment we originally presented. What you see in the color
photos is a trailer mounted feeder and jaw(or impact) crusher, which essentially reduces the size
of the material for secondary crushing. This unit comprises an area approximately 12 feet by 50
feet.
You will also see in the photo another trailer mounted screening and secondary crushing plant that
comprises an area approximately 10 feet by 45 feet. Last, you will see a generator set and electric
switch gear and control panel unit (both trailer mounted) approximately 8 feet by 40 feet.
There are assorted conveyor belts to connect and convey the crushed material to stockpiles,
which will average an area of approximately 10 feet by 50 feet.
The height of the compact crusher is 25 feet instead of the 35 feet we originally presented. The
overall area of the crusher will actually occupy an area smaller than the 250 feet by 250 feet we
first described to you.
