Hare, City Clerk_ DATE: November 7, 1997 (CC meeting 190 .-/ ITEM i • G • CITY OF MOORPARK, CALIFORNIA City C uncil Meeting of ACTION:•` =� -�' , Z`t 1�'- 2'Zd� -�-� BY: SUBJECT: CONSIDER USE OF WRITTEN STATEMENT CARD AT COUNCIL MEETINGS BACKGROUND Several speakers have indicated that they would like to use a written statement card to leave their comments for the Council rather than speak to an item on the City Council Agenda. The City also received a suggestion card requesting the creation of a written statement card. At the last meeting of the Rules of Procedure Ad Hoc committee, Mayor Hunter asked that staff prepare a written statement card. The attached written statement card was prepared by staff and reviewed by the City Attorney who indicates that the following must be considered when incorporating the use of the written statement card into our meeting procedures: 1. Written statement cards received for public hearing items must be read into the record by the Mayor, City Clerk or other designated person. If a voluminous comment is received, the main points of the comment could be summarized for the record. 2. Written statement cards must be incorporated into the minutes. Staff suggests they be transcribed into the minutes. The City of Thousand Oaks uses a written statement card. The mayor reads the names of those submitting speaker cards and whether they are opposed to or in favor of the item being discussed. The written statement cards are appended to the minutes. In the City of Simi Valley, the speaker card includes boxes that can be checked to indicate whether a person is opposed to or in support of a project or appeal and whether the person submitting the card wishes to speak or not. The mayor reads the names of the people submitting the speaker card and whether they are opposed to or in favor. If many speaker cards are received, the mayor does not read the names but indicates the numbers opposing and in favor and states that the minutes will reflect the names of all those submitting speaker cards. 000063 Agenda Report November 10, 1997 Page 2 Written statement cards received for non public hearing items need not be read into the record but the Council may want the name and position (in favor of or opposed to) of the person submitting the card read for the public and Council's information. Some additional questions to consider are: 1. Should cards be read into the record if they are received prior to the normal receipt of speaker cards? 2. If number 1 above is yes, then should letters received prior to the meeting be read at the meeting? An alternative to a written statement card would be to add boxes on the City's existing speaker card to be marked to indicate opposition or support and a box to be marked to indicate that the person submitting the speaker card does not wish to speak. Direct staff as deemed appropriate. A limitation of 3 minutes shall be imposed upon each speaker. ElPUBLIC HEARING* Speakers who wish to address the Council concerning a PUBLIC HEARING item must do so during the Public Hearing for that item. Testimony by an Applicant will be heard first, followed by all other speakers in the order that their Speaker Cards are received by the City Clerk prior to the beginning of the Public Hearing. The Mayor may, at the beginning of the Public Hearing, limit testimony, depending on the extent of the agenda and the number of persons wishing to speak. At a continued Public Hearing anyone who previously spoke will be limited to three minutes. PRESENTATIONS /ACTION /DISCUSSION* Speakers who wish to address the Council concerning a PRESENTATIONS /ACTION /DISCUSSION item must do so during the Presentations /Action /Discussion portion of the Agenda for that item. Speakers for Presentations/ Action /Discussion will be heard in the order that their Speaker Cards are received by the City Clerk prior to the first item of the Presentations /Action /Discussion portion of the Agenda. A limitation of 3 minutes shall be imposed upon each speaker.
