Subject: Consider Conceptual Approval of the Proposed
Relinquishment of Certain Surplus Freeway Right -of -Way
to the City, Located on the North Side of Tierra Rejada
Road Just West of the Route 23 Freeway [Tract 4974]
DISCUSSION
Carlsberg Development Company is in the process of constructing
off -site improvements along the arterial and collector streets
within and surrounding the property encompassed by the Carlsberg
Specific Plan, as required by the Conditions of Approval of the
Large Lot Subdivision. Those improvements include street widening
along the north side of Tierra Rejada Road [Tract 4974].
It has recently been determined that there is a "sliver" of street
right -of -way, approximately 9' wide and 211' long, along the north
side of Tierra Rejada Road just west of the southbound Route 23
freeway off -ramp (Exhibit 1), which is actually a part of the
freeway (Caltrans) right -of -way. A portion of the improvements
which Carlsberg is to construct is actually within that "sliver" of
Caltrans freeway right -of -way.
If Carlsberg were to proceed with the construction of required
Tierra Rejada Road improvements (retaining walls, sidewalks, etc.)
upon Caltrans property, it would be necessary to seek and obtain
Caltrans approval. The administrative "red- tape" associated with
pursuing that course of action is expected to be extremely
burdensome, time consuming and expensive. Carlsberg has requested,
therefore, (see Exhibit 2) that the City approve in concept the
proposed future relinquishment of this "sliver" of street right -of-
way (surplus freeway right -of -way) from Caltrans to the City. With
City Council concurrence with this concept, Caltrans is prepared to
allow Carlsberg to proceed with these improvements as if they were
not within Caltrans right -of -way, and to process the relinquishment
at a later date.
RECOMMENDATION
Staff recommends that the City Council approve in concept the
proposed future relinquishment to the City of certain surplus
Caltrans right -of -way located on the north side of Tierra Rejada
Road west of the Route 23 freeway as shown in Exhibit 1 of this
report.

It is my understanding that you met with Mr. Lloyd Laycook on November 5, 1997 to discuss the
timing and conditions under which Carlsberg could proceed with the construction of a retaining
wall on the north side of Tierra Rejada Road near the southbound off -ramp from the "23"
Freeway. In this regard, Mr. Laycook brought to your attention the fact that Carlsberg recently
discovered that because of the irregular alignment of City of Moorpark and CalTrans right of way
("ROW") at the above mentioned location, a small portion of the retaining wall now lies within
CalTrans ROW.
Although the City of Moorpark City Engineer and Director of Building and Safety have approved
the plans and specifications of the retaining wall, because of the small encroachment into CalTrans
ROW, CalTrans must now separately plan check, approve, and permit the retaining wall. The
duplicative process that Carlsberg must encounter to construct its retaining wall will now add
time and expense to an improvement important to the City of Moorpark and Carlsberg to be
installed.
As an alternative to the lengthy CalTrans process, Mr. Laycook discussed with you the possibility
of the City of Moorpark accepting from CalTrans a transfer of their ROW (which CalTrans has
stated it would approve). In order to proceed with this alternative, however, the City Manager
and City Council would have to agree with accepting the small portion of CalTrans ROW.
