SUBJECT: Consider Adopting Two Resolutions Providing for the Enforcement of the
California Vehicle Code Upon Certain Areas Within Tracts 4973, 4974, 4975,
4976,4977 and 4980 [Lennar Communities and Carlsberg] Generally Described
as Follows: A) Future Private Residential Streets; and B) Future Commercial
Parking Facilities
DISCUSSION
A. Future Private Streets
All of the future streets to be constructed within the residential tracts in the Carlsberg Specific
Plan area (Tracts 4975, 4976, 4977 and 4980) are to be private roads with gated, restricted
access (see the Resolution attached as Exhibit 1 for location). As such, said private roads will
not to be held open for public use. Nevertheless,these private roads will be in close proximity
to, or connected with, a highway. The interests of those residing on said private roads, as well
as the motoring public, will best be served if the provisions of the California Vehicle Code
(CVC) were made applicable to said private roads.
Section 21107.7 of the CVC requires that prior to City Council taking action to authorize
enforcement of the CVC on private roads not held open to public use, a petition requesting
same, signed by the majority of the land owners, must first be filed with the City. The
attached letter(Exhibit 3)from the owner and developer of Tracts 4975, 4976, 4977 and 4980
is deemed to satisfy that requirement.
CVC Section 21107.7 requires that a public hearing be held on the matter prior to taking
action, and that the property owner be notified of said hearing at least ten (10) days prior to
said hearing. A public hearing for this purpose has been scheduled for today. Also, the
owner(s)of Tracts 4975, 4976, 4977 and 4980 has been provided at least ten (10) day advance
notice of this public hearing.

B. Future Private Commercial Parking Facilities
Section 21107.6 of the CVC allows for enforcement of said Code upon privately owned and
maintained roads within commercial centers. Section 21107.8 of said Code allows for
enforcement of certain provisions of the CVC pertaining to speeding and other matters, upon
privately owned and maintained off-street commercial parking facilities.
The properties within Tracts 4973 and 4974 (see the Resolution attached as Exhibit 2 for
location)will be developed for Office/Professional or Commercial/Industrial purposes. The
owner(s) of these properties has requested that provisions of the CVC be enforced upon the
future privately owned and maintained roads and parking facilities to be constructed upon
those properties (Exhibit 4).
The CVC requires that action to make the CVC applicable to private parking facilities and the
roads which serve them, may not occur prior to holding a public hearing on the matter, and
that the property owner be notified of said hearing at least ten (10) days prior to said hearing.
A public hearing for this purpose has been scheduled for this date. Also, the owner(s) of
Tracts 4973 and 4974 has been provided at least ten (10) day advance notice of this public
hearing.
If approved, these traffic and parking regulations will not take effect until appropriate signs
giving notice of such enforcement, have been posted and maintained by the property owner.
RECOMMENDATION
Staff recommends that the City Council take the following actions:
1 Adopt Resolution No. 98- (Exhibit 1) finding all of the future private roads to be
constructed within Tracts 4975, 4976, 4977 and 4980 [Lennar Communities], shall be subject
to the provisions of the CVC.
2. Adopt Resolution No. 98- (Exhibit 2) making the CVC applicable to certain private
roads and parking facilities upon the future commercial/industrial property within Tract 4973
and 4974 [Carlsberg].

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
MOORPARK, CALIFORNIA, FINDING AND DECLARING
CERTAIN EXISTING AND FUTURE PRIVATE ROADS NOT
HELD OPEN FOR PUBLIC USE, WITHIN TRACTS 4975,
4976, 4977 and 4980 [LENNAR COMMUNITIES] SUBJECT TO
THE PROVISIONS OF THE CALIFORNIA VEHICLE CODE
WHEREAS, all of the future roads to be constructed within Tract 4975, 4976, 4977 and 4980
[Lennar], as generally shown on Exhibit'A' attached hereto and made a part hereof, are to be private
roads with gated, restricted access; and,
WHEREAS, although said private roads are not to be held open for public use, said roads will
be in close proximity to or connected with a highway and the interest of those residing on said
private roads, as well as the motoring public, will best be served by application of the California
Vehicle Code (CVC) to said private roads, and,
WHEREAS, the CVC may not be enforced on said private roads generally not held open for
public use,unless and until action is taken by the City Council, pursuant to Section 21107.7 of the
CVC, making said private road subject to the provisions of said Code; and,
WHEREAS, said CVC Section requires that such action may not be taken without the City
first receiving a petition requesting said enforcement, signed by the majority of the owners of the
property affected; and;
WHEREAS, the City is in receipt of a letter from the owner(s) of the residential properties
to be developed within Tracts 4975, 4976, 4977 and 4980, requesting that said private streets be
subject to the CVC; and,
WHEREAS, said CVC Section also requires that such action may not be taken without first
holding a public hearing on the matter and that at least ten (10) day prior notice be provided to the
owners of the properties affected; and,
WHEREAS, such notice was provided to the owner(s) of the residential properties to be
developed within Tracts 4975, 4976, 4977 and 4980 [Lennar Communities], advising them of the
date and time of a public hearing on the matter; and,
WHEREAS, a public hearing has been held on the matter. ,

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK,
CALIFORNIA, DOES HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS:
SECTION 1. That all of the private roads to be constructed within Tracts 4975, 4976, 4977
and 4980 [Lennar Communities], shall be subject to the provisions of the CVC.
SECTION 2 That this resolution shall take effect immediately.

RESOLUTION NO. 98 -
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
MOORPARK, CALIFORNIA, FINDING AND DECLARING
CERTAIN FUTURE PRIVATE ROADS AND PARKING
FACILITIES TO BE LOCATED IN TRACTS 4973 AND 4974
[CARLSBERG] SHALL BE SUBJECT TO THE PROVISIONS
OF THE CALIFORNIA VEHICLE CODE
WHEREAS, Section 21107 6 of the California Vehicle Code (CVC) allows for the
enforcement of said Code upon privately owned and maintained roads generally held open to the
public for purposes of vehicular travel to serve commercial establishments; and,
WHEREAS, Section 21107.8 of the CVC allows for the enforcement of CVC Section 22350,
23103, 23109 and Division 16.5 (Section 3800 et. seq.) upon privately owned and maintained off
street parking facilities which are generally held open for use by the public for vehicular parking;
and,
WHEREAS,the owner(s)of the properties to be developed for commercial purposes within
Tracts 4973 and 4974, as generally depicted on Exhibit'N, attached hereto and made a part hereof,
has requested that the provisions of the CVC be enforced upon the privately owned roads and
parking facilities to be constructed upon the properties within those tracts; and,
WHEREAS, pursuant to the requirements of said Code, a public hearing has been held on
the matter and the owner of the affected property was notified of said hearing at least ten (10) days
prior to the date thereof.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK,
CALIFORNIA, DOES HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS:
SECTION 1. That, pursuant to CVC Sec. 21107.6, the privately owned and maintained
access roads to be constructed within Tracts 4973 and 4974, as generally shown on Exhibit 'A',
which are generally held open to the public for the purpose of vehicular travel to serve commercial
establishments, shall be subject to the provisions of the CVC.
SECTION 2. That, pursuant to CVC Sec. 21107.8, the privately owned and maintained
parking facilities to be constructed within Tracts 4973 and 4974, as generally shown on Exhibit'A',
which are generally held open for use by the public for vehicular parking, shall be subject to CVC
Section 22350, 23103, 23109 and Division 16.5 (Section 3800 et. seq.) of the CVC.

SECTION 3. That the above traffic and parking regulations shall take effect upon the
placement of appropriate signs giving notice of said regulations.
SECTION 4. That said signs shall be placed and maintained by the property owner(s) and
or property manager(s) of the properties within Tracts 4973 and 4974.
SECTION 5. That said signs shall comply with the requirements set forth in Section
21107 6 (b) and Section 21107.8 (b) of the CVC.

John Jameson requesting a letter authorizing the City of Moorpark to enforce all
California Vehicle Codes with the Carlsberg specific Plan area. Lennar
Communities is in full support of your request.

We acknowledge receipt of your letter dated June 16, 1998 regarding the above referenced matter as it relates to
the future public streets and private parking areas (in the commercial lots) within the Carlsberg Ranch. With
regard to the future private streets contained within approved Tentative Tracts 4975, 4976, 4977, and 4980,
which are owned by Lennar Homes, Inc.,the undersigned has forwarded a copy of your letter to Lennar for their
response to your request.
