SUBJECT: Consider Adopting Three Resolutions Providing for Enforcement of the
California Vehicle Code in Privately Owned Streets and Parking Facilities
Located at 3941 and 3987 Spring Road [Marketplace Properties -- Commercial
Planned Development Permit No. 95 -1], 484 East Los Angeles Avenue [Tops
Management Company], and Tract 4637 Phase 1 [Mountain Meadows Villaggio
Homeowners Association].
EXECUTIVE SUMMARY
This presents for consideration at a public hearing, a resolution making the privately owned streets
and parking facilitates located at 3941 and 3987 Spring Road [Marketplace Properties --
Commercial Planned Development Permit No. 95 -1], 484 East Los Angeles Avenue [Topa
Management Company], and Tract 4637 Phase 1 [Mountain Meadows Villaggio Homeowners
Association] subject to certain provisions of the California Vehicle Code (CVC).
DISCUSSION
A. Authority
The City enforces the CVC in a number of privately owned streets and parking areas on
commercial/industrial property and multi - family residential developments. Enforcement of the
CVC on private property requires adoption of a resolution by the local agency at the request of
the property owner.
B. Request
The City is in receipt of a request from Marketplace Properties (Exhibit 1), Topa Management
Company (Exhibit 2) and Mountain Meadows Villaggio Homeowners Association (Exhibit 3)
that the Vehicle Code be enforced in streets and parking lots on their property.
C. Notice
As required by the CVC, a notice of this Public Hearing was sent to all property owners.

RECOMMENDATION
Staff recommends that the City Council take the following actions:
Adopt Resolution No. 98- — (Exhibit 1) finding all of the future private roads and parking
facilities upon the future commercial property to be constructed at 3941 and 3987 Spring Road
[Marketplace Properties -- Commercial Planned Development Permit No. 95 -1], shall be
subject to the provisions of the CVC.
2. Adopt Resolution No. 98- (Exhibit 2) making the CVC applicable to certain private roads
and parking facilities upon the commercial property located at 484 East Los Angeles Avenue
[Topa Management Company].
3. Adopt Resolution No. 98- (Exhibit 2) making the CVC applicable to certain private roads
and parking facilities upon the multi - family residential property within Tract 4637 Phase 1
[Mountain Meadows Villaggio Homeowners Association].

City of Moorpark to enforce appropriate vehicle codes upon completion in the common area of
the Rite Aid Drug and Kindercare Learning Center Project located at the NWC of Tierra Rejada
and Spring Road, Moorpark, CA as permitted by Vehicle Code Section 21107.7.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
MOORPARK, CALIFORNIA, FINDING AND DECLARING
CERTAIN FUTURE PRIVATE ROADS AND PARKING
FACILITIES TO BE LOCATED AT 3941 AND 3987 SPRING
ROAD [MARKETPLACE PROPERTIES -- COMMERCIAL
PLANNED DEVELOPMENT PERMIT NO. 95 -11, SUBJECT
TO PROVISIONS OF THE CALIFORNIA VEHICLE CODE
WHEREAS, Section 21107.6 of the California Vehicle Code (CVC) allows for the enforcement
of said Code upon privately owned and maintained roads generally held open to the public for
purposes of vehicular travel to serve commercial establishments; and,
WHEREAS, Section 21107.8 of the CVC allows for the enforcement of CVC Section 22350,
23103, 23109 and Division 16.5 (Section 3800 et. seq.) upon privately owned and maintained off
street parking facilities which are generally held open for use by the public for vehicular parking;
and,
WHEREAS, the owner(s) of the properties to be developed for commercial purposes to be
located at 3941 and 3987 Spring Road [Marketplace Properties -- Commercial Planned
Development Permit No. 95 -1], as generally depicted on Exhibit'l', attached hereto and made a part
hereof, has requested that the provisions of the CVC be enforced upon the privately owned roads
and parking facilities to be constructed; and,
WHEREAS, pursuant to the requirements of said Code, a public hearing has been held on the
matter and the owner of the affected property was notified of said hearing at least ten (10) days prior
to the date thereof.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK,
CALIFORNIA, DOES HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS:
SECTION 1. That, pursuant to CVC Sec. 21107.6, the privately owned and maintained
access roads to be located at 3941 and 3987 Spring Road [Marketplace Properties -- Commercial
Planned Development Permit No. 95 -1], as generally shown on Exhibit'l', which are generally held
open to the public for the purpose of vehicular travel to serve commercial establishments, shall be
subject to the provisions of the CVC.
SECTION 2. That, pursuant to CVC Sec. 21107.8, the privately owned and maintained
parking facilities to be located at 3941 and 3987 Spring Road [Marketplace Properties --
Commercial Planned Development Permit No. 95 -1], as generally shown on Exhibit'l', which are
generally held open for use by the public for vehicular parking, shall be subject to Section 22350,
23103, 23109 and Division 16.5 (Section 3800 et. seq.) of the CVC.

SECTION 3. That the above traffic and parking regulations shall take effect upon the
placement of appropriate signs giving notice of said regulations.
SECTION 4. That said signs shall be placed and maintained by the property owner(s) and/
or property manager(s) of the properties located at 3941 and 3987 Spring Road.
SECTION 5. That said signs shall comply with the requirements set forth in Section
21107.6 (b) and Section 21107.8 (b) of the CVC.

Dear Public Officials,
The Board of Directors of Mountain Meadows Villaggio respectfully requests the City of
Moorpark to enforce City parking regulations on our property. The complex is located on
Mountain Trail to the West, Torino to the East, Cedar Springs to the North and Mountain
Meadow to the South.
Please bring our request before the City Counsel at your earliest convenience for their
approval. If there are specific forms to be completed in order to facilitate the process
please forward them to me at the address above.
I understand once we have City Counsel approval, you will instruct us as to what signs
need to be posted to put all residents an guests on notice that parking regulations will be
strictly enforced.

and made a part hereof, has requested that the provisions of the CVC be enforced upon the privately
