SUBJECT: Consider Selection of a Consultant to Prepare a Finance
/ Implementation Plan for the Gabbert Canyon / Walnut
Canyon Channels Deficiency Study
BACKGROUMD
1. In 1996 the Ventura County Flood Control District (VCFCD)
retained the services of Robert Bein, William Frost & Associates
to prepare a study to evaluate the deficient drainage facilities
serving the Walnut Canyon watershed and the Gabbert Canyon
watershed, and to recommend alternative design concepts aimed at
correcting those deficiencies.
2. In June of 1997, the City Council reviewed that draft study and
concurred with the recommendations of the consultant, VCFCD and
City staff with regard to the preferred conceptual design
alternate for the needed future improvements. Subsequently, the
VCFCD adopted that design option as the approved Design
Alternate for the future drainage improvements required for
these watersheds.
3. Attached as Exhibit 1 is a diagram illustrating the project(s)
proposed by the approved Design Alternate. These proposed
drainage improvements consist of a combination of detention
(construction of a number of new detention basins), diversion
(construction of a new north -south drain line in the vicinity of
Shasta Avenue) and channel capacity improvements. The total
cost of these proposed drainage improvements is estimated to be
in excess of $13 million.

Considerable interest has been expressed by owners, or agents
representing owners, of a number of the properties within these
watersheds, to proceed with plans for the development of those
properties. The properties expressing such interest include: the
developers of Specific Plan #1; Westpoint (T4620); Suncal
Properties; Tract 5130 (Revision to SP -10); and, the proposed
Industrial Site on the north side of Los Angeles Avenue west of the
SCE sub - station (Bugle Boy). of course, the conditions of approval
for each of those future developments will require the construction
or funding of a "fair- share" portion of the required drainage
improvements. It is necessary, therefore, for the City to
determine what the "fair- share" distribution of those costs will
be.
In order to accomplish this task, it will be necessary for the City
to develop a method and means to equitably allocate the cost of the
required drainage improvements to the properties to be benefitted
by those improvements. Accordingly, City staff asked Robert Bein,
William Frost & Associates to submit a proposal (Exhibit 2) for the
preparation of a Project Implementation Financial Plan for the
required drainage improvements. The scope and purpose of that
report is generally described as follows:
1. evaluate financing options: public, private, assessment
district, applicability, economic feasibility, practical
feasibility, etc.;
2. review and update prior project construction cost estimates;
3. define properties to be benefitted, develop rules /methodology
for the equitable spread of costs to benefitted properties,
prepare preliminary benefit spread formula(s), prepare
preliminary assessment spreads (assessment amounts) to
benefitted properties; and,
4. define an implementation schedule / priority list of required
improvements.
The fee for this study is $18,200. The funding source will be
advance deposits by one or more of the above mentioned developers.
It should be noted that this study will not necessarily identify
the requirements for each property to be developed. It will only
provide amount for a "fair - share" distribution of drainage
improvement costs. Using this information, staff (with input from
the VCFCD) will develop the actual conditions and requirements for
each property on a case by case basis, taking note of such factors
as current risk of inundation, current and proposed storm water
run -off and order of development.

Staff recommends that the City Council take the following actions:
1. Approve the selection of Robert Bein, William Frost & Associates
(RBF) to prepare a Finance / Implementation Plan for the Walnut
Canyon / Gabbert Canyon drainage improvements, for a fee not to
exceed $18,200.
2. Direct staff to work with the developers of properties within
these watersheds to obtain advance payment of the fees required
for the subject study and authorize the City Manager to sign an
Agreement with one or more of those developers to provide for a
credit in favor of said developer(s), against future payment of
development fees or improvement costs.
3. Authorize the City Manager to execute a contract with RBF for
said services, upon receipt of said advance payment.

TASK 1.0 Evaluation of Funding Mechanisms
Evaluate potential public funding mechanisms to implement the regional
flood control improvements. Determine the acceptability of the various
programs and special requirements. Perform initial financial evaluation
through examination of the current tax base to determine level of
assessments. Investigate the disadvantages and advantages of various
funding programs, which include a potential combination of various
funding sources. A decision / comparision matrix will be prepared to assist
in defining the recommended program
TASK 2.0 Review and Modify Construction Cost Estimates
Review previously developed construction cost estimates for the
implementation of the regional flood control improvements and adjust the
estimated costs based upon potential modifications which conform to more
current information or requirements within the watershed. Make
adjustments to recommended facilities based upon anticipated landuse.
TASK 3.0 Preliminary Distribution of Assessments
Identify potential limits of parcels to establish a benefit assessment area
and provide a nexus for the fee assessment. Formulate the rules and
methodology to spread costs to various parcels within the proposed
assessment area based standard public financing conventions. Based upon
the preliminary engineers estimate complete a preliminary spread of costs
or exactions in the form of land reservations.
TASK 4.0 Preliminary Engineering Report
Prepare a technical report which documents the evaluation of a financing
program for the regional flood control program implementation. The report
will outline the review of the various financing options available and
provide a matrix which assists in defining the optimum program. Report
shall provide exhibits which defines the drainage fee assessment
boundaries and maps. The report is intended for internal use by the City in
planning the financing program and excludes processing or modifications
for additional agencies.
TASK 5.0 Technical Consultation and Coordination
Provide technical assistance for consultation on the formulation of the
financing program with the City and watershed stakeholders. Consultation
will include provide other information and assistance as required to the
City. Consultant shall attend regularly schedule meeting with the City to
review the progress of the work and provide consulting services. The fee
for this work item is a budget amount and is based upon providing 40
manhours of consultation, should this amount be exceeded then additional
work will be performed under separate addendum.

E. REIMBURSABLE
RBF will, in order to perform the previously discussed tasks, incur
reimbursable expenses such as printing, reproductions, messenger services,
facsimiles and other project - specific out -of- pocket expenses necessary to
achieve preparation and processing of the previously discussed tasks. Such
costs will be reimbursed at cost on a monthly basis. Agency fees,
processing charges and plan check fees are not included as reimbursable
and will be paid for separately by the Client.
F. CLIENT RESPONSIBILITIES
The project efforts and schedule to be performed by the Consultant are
based upon the assumption that the Client will be responsible for providing
the following to the Consultant:

Robert Bein, William Frost & Associates will complete the work outlined herein and invoice Client monthly
on a percentage of completion basis, a total fixed fee of $18,200, plus direct costs of reimbursable expenses in
accordance with the Schedule of Professional Fees below.

Progress billing will be forwarded to the Client on a monthly basis. These billings will include the fees earned
for the billing period plus costs advanced by the Consultant. The Client shall make every reasonable effort to
review invoices within fifteen (15) working days from the date of receipt of the invoices and notify Consultant
in writing of any particular item that is alleged to be incorrect.
