Food and Beverage Vending Machines in City Parks
The City is in receipt of a request from a Moorpark resident, Mr. Stanley, to install a vending
machine in a City park. To date, it has been the City's policy not to allow food or beverage
vending machines in City parks. With this recent request, staff felt that this was a good opportunity
for the City Council and the Park and Recreation Commission to formally review, and either up
hold the current policy, or make revisions.
Currently, the City has food and beverage vending machines located inside the Arroyo Vista
Recreation Center and the Community Center. When the decision was made to install the
machines, the City solicited proposals from vendors and authorized an agreement with the
successful contractor. The Agreement the City has with its current vending machine contractor
includes providing and maintaining the machines and their contents at no cost to the City, City
approval of the food and beverage items stocked, and monthly payments to the City of 20 percent
of gross receipts. Total revenues received from the vending machines for FY 1997/98 was $2,318.
The City has not experienced any problems with the vending machines at its two current sites. As
stated above, the machines are located inside of City owned facilities where staff is generally
present to handle customer complaints and to discourage abuse of, or vandalism to, the machines.
If vending machines were allowed in City parks, they would be enclosed in a cage, which is typical
for machines located outside, to minimize vandalism. Most likely, they would be located next to
restroom facilities and near an electrical source. For aesthetic reasons, it is preferable to place the
machine in a location that is not visible from the street, however this makes them more vulnerable
to vandalism. To discourage vandalism and groups of individuals from congregating around the

machines, placing them in locations with easy visibility from the street by passing police patrol
vehicles is desirable.
At its meeting on July 6, the Parks and Recreation Commission considered the matter of vending
machines in parks and recommended that the City Council approve the placement of a beverage
vending machine at Peach Hill Park on a trial basis. Peach Hill Park gets sufficient use in the
evenings, since the City holds its adult softball leagues there, and the restroom/storage room is
located at the front of the park and near the street. Currently, there is no direct access to an
electrical outlet at the park, but one could be added at a cost of approximately $200 near the
location of the pay phone (southeast side of the restroom/storage room building).
In speaking to the City's current contractor, he indicated that in order to make an investment in a
machine and an accompanying cage, he would need a minimum one year contract. Therefore,
should the Council wish to pursue a trial period, it may want to consider making it for a year.
Language could be included in a contract that would allow for the termination of the contract in the
event that the machine received excessive vandalism and/or proved to be a magnet to individuals to
congregate after hours.
In addition to the resident who requested consideration of a beverage vending machine in Peach
Hill Park, the City's current contractor, Take 5 Office Break Services, also expressed an interest if
the City made a move in that direction. The City is under no legal obligation to competitively bid
the a contract for vending machines, although it did so back in June, 1994. At that time, the City
received only one complete proposal. Staff suggests that the City Council consider authorizing the
offer of a one -year contract to Mr. Stanley for a beverage machine, pending his ability to meet the
terms of the existing contract, and to advance to the City the cost of installing an electrical outlet.
If he is unable to do so, an offer could then be made to Take 5.
Recommendation
Parks and Recreation Commission and staff recommend that the City Council approve the
placement of a beverage vending machine at Peach Hill Park, at the location specified, for a period
of one year, and staff recommends that the Council authorize the City Manager to offer and sign a
contract as outlined in this agenda report.
