F) ITEM AGENDA REPORT CITY OF MOORPARK CITY OF MOORPARK, CALIFORNIA City ouncil ?Meeting 10 of a TO: THE HONORABLE CITY COUNCIL Acrl A 42 e rc P� FROM: DIRK LOVETT, ASSISTANT CITY ENGINEER Prepared by: David Grantham, Assistant Engineer BY: DATE: JULY 22, 1998 (CC MEETING OF AUGUST 19, 1998 ) . `—T— SUBJECT: CONSIDER APPROVAL OF A CERTIFICATE OF ACCEPTANCE FOR AN EASEMENT FOR A SIDEWALK ON THE SOUTH SIDE OF LOS ANGELES AVENUE, CPD 97 -1 AND CUP 97 -2 (GHAREBAGHI) BACKGROUND On November 19, 1997 the City Council approved CPD 97 -1 and CUP 97 -2 for Mr. Ahmed "Eddie" Gharebaghi to construct a gas station and car wash at the southwest corner of Los Angeles Avenue and Liberty Bell Road. Site improvements include grading and construction of driveways on Liberty Bell Road and Los Angeles Avenue. A vicinity map is attached for your reference. DISCUSSION Conditions for this project require a transition between the existing sidewalk to the east, located adjacent to the curb along Los Angeles Avenue, and future sidewalk to the west. Condition No. 99(f) of CPD 97 -1 states that the new sidewalk west of the Los Angeles Avenue driveway shall be 6 feet wide and located on private property behind an 8 foot parkway strip. An easement deed has been prepared which will allow public access and maintenance of the sidewalk lying within private property. The location of the subject easement within the project site is shown in Exhibit A of the easement deed attached. A Certificate of Acceptance from the City of Moorpark is required to record this easement deed. RECOMMENDATION: 1. Approve the Certificate of Acceptance for the public sidewalk and maintenance easement south of Los Angeles Avenue and; 2.
